Submitting last year tax documents for NVC

Timeline

Hi All,

I did my taxes on last day April 15th and send it by mail since wife didn't have social security number. The IRS has since cashed in my check so they have received and processed it which is all good.The tax transcript however is not available online yet for year 2013 and I don't expect to become available soon. I have 2 part question.

1. I was planning submitting IRS tax transcripts for prior years and my tax returns for 2013 since the transcript is not available. Is that fine or should I strive to get the transcript or other kind of confirmation from IRS?

2. I have rental property this year which is declared in 2013 taxes. Do I have to send document regarding that as well? I do have regular W2 income which is well above the required income.

Also since we are at it, does NVC ultimately schedule the interview date when case is approved or I have to wait for it from the US Embassy? It would be nice if I can get that from NVC so I can give notice to my tenants.

1. After April 15th you have to use the tax transcript or return from 2013. If you did AOS before that date then you could have been fine with 2012 tax transcript or return.

2. Since you have to use 2013 tax transcript or return, the income from the rental property would be included in the transcript or return.

I assume that the transcript will be available soon but can't you use a copy of your signed 2013 tax return?

Thanks, I hope so but I didn't do electronic transmission of taxes because my wife doesn't have social security number and my tax adviser told me you have to send in by post in this case. I thought it would take longer to get fully processed due to that and transcript to be available although they cash in the check faster.

And yes that's what I was planning to send (2013 tax return). I assume it will contain everything regarding the rental property as well so I don't have to send anything extra right? I just want to make sure I send in everything correct the first time. Thanks.

I had to send my return by post this year too because of a similar situation with my husband. I was still able to get my 2013 tax transcript in the mail from the IRS. I had money being returned to me. Once I got the check from the IRS, I requested the transcript and got it.

If you included the income from the rental property and are using form 1040 then yes, it should be included in the "total income" figure.

I was still able to get my 2013 tax transcript in the mail from the IRS.

How long did it took after the tax return? The IRS online website wouldn't let me order by post because it says the transcript for 2013 doesn't exist yet. I called local IRS offices, they don't service via phone. I called the IRS transcript hotline number (automated) and it says the same thing that it is not available. How did you order it and roughly how long was it after you filed return? Thanks.

Do not forget to attach copies of the W2 and 1099s with your copy of the signed 2013 Tax return.

If you don't want to wait for a transcript to be available, just send a complete copy of the tax return instead. If your rental property results in additional income, no problem. If you took a loss due to depreciation, etc. it COULD be a problem. The income number you put on the I-864 for past years' taxes is from line 22 on the 1040 or the line labeled "total income" from the tax RETURN TRANSCRIPT. Sounds like you are both employed and self employed, so unless the rental "income" (or loss) is a very minor part of your financial picture, you will use the number on line 22 as your "current income" as well.
