**Moderator hat off**

For starters, an I-130 is a petition form, not an application form. If you are petitioning a step child in addition to a spouse, then two petitions (along with the fee) will need to be submitted.

Two petitions, two fees, two processes in parallel. Your question indicates you have not yet effectively studied the I-130 instructions. Doing so, will be critical to your ultimate success.

Thanks for your advice. Didn't know that however before submitting the petition I spoke with a lawyer and was told one petition and the child since the child under 18 will be included. This is why I ask the question here because I did not use the lawyer, too much money .

The lawyer was evidently talking about the K3/K4 visa process that is actually obsolete. For the CR1/CR2 or IR1/IR2 process, for the spouse and step child of a US Citizen, you'll find the requirements shown on the I-130 instructions match the information you've been given here. Study those instructions carefully.

Is your petitioner a US citizen?

As Canadians, you can travel to the US visa-free for tourism/temporary purposes only. If you enter the US with intent to immigrate/adjust status using VWP, that's considered fraud.

I don't know if the process is different for Canadians , because as Canadians we don't need a visa to travel to the US . ( I am the beneficiary )

You have a visitor privilege that is unique to Canadians but the immigration process is the same as from any other country, at least regarding the forms required. One petition per immigrant with immigrating as a spouse or step child of US Citizen using the CR1/2 or IR1/2 processes. Take it to the bank.

Yes my petitioner is a US citizen

I don't have any intention to enter the US with the intend to stay I only visit and return back to canada .

My only concern is that my petitioner submit i130 petition for me and he only list my daughter under the section C " information about your relative .

He also enclosed 420 which is one fee.

Is this correct , or should submit one for me and a one for my daughter and fees for both ????

He should submit a separate i130 for your child (his step daughter) and a separate $420 cheque for it.

It should be:

i130 and $420 cheque for you

i130 and $420 cheque for daughter
