Us citizen and finacee both living abroad

Hi,

I was wandering if anybody else has filed for a K1-visa with the US-citizen living abroad together with the fiancee.

My boyfriend is a US citizen and we met while I was working in the US on a expat visa. I applied for a job in Toronto and we moved together to Canada. Now 2.5 years later we are looking to move back to the states and raise our 2 kids (18monts and 2 months) there.

However we can not show income for my boyfriend as he does not live in the US so does not have US income. We do have a house in the US (together) where we will live when we move and we currently live in a house in Canada which we will sell when we move and give us profits.

Now I'd like to hear from somebody in the same situation to see if the assets alone will work to move and if so does it need to be 3times or 5 times the poverty guidelines and since we own it together will only have of the profits count?

Or do we need a cosponsor? I would like to avoid this as I don't want anybody to ever have to guarantee for me.

Timeline

Sounds like a case for Direct Consular Filing. I don't know that much about it or if you even qualify but if you do, it should be easier than going the K-3 route.

Well we decided to take the K1 visa approach (we're not married yet), cause currently this is the faster way. Ideally we would want to move sometime between september and december this year, since our house in the US is rented per year and it ends in september. Also don't we have to show affidavit for either visa anyway?

Hi, I'm not in Canada so not an expert by any means but have been following most posts about proving domicile, and other issues for USC filing from abroad since I was abroad until a couple of months ago. I didn't have US income and was concerned about proving US domicile so returned to the US to look for a job and then file K1. I've noticed that quite a few USC in Canada have posted about having difficulty providing evidence of US domicile while living in Canada. So in addition to researching how to file based on assets, make sure you are well informed about what you'll need to do to show evidence of establishing US domicile. Good luck!
