Married Name on I-130 vs. Maiden

Hello. I was just doing a final look over my I-130 app before I send it in this weekend, when I came across some threads about it possible being better to use the married name for the beneficiary on the form. I have a couple of questions.

1. Is it better to send in the forms with the married name vs. the maiden name, and if so, why?

2. Would I also use the married name on the G-325A, and if so, could I just put a line through the maiden name and write in the married name?

For starters, an I-130 is not an "app," it's a petition form you are filing.

Does the beneficiary plan on taking a married name or keeping her maiden name? If they plan to have a married name, then it's perfectly fine to complete the applicable forms using the married name and writing the maiden name in the "other names used" field. One thing to remember, if the beneficiary is planning to take a married name, they will need to update their passport to reflect that because the visa will be issued with the name that is in the passport and the green card will match the name on the visa.

July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!

I would use my husbands last name....it took me a total of 1 month to get back to the States and change everything which also included having our marriage license translated (done in Colombia) and had my SSN changed.

Now as for drawing a line through it and changing it to the married one if I was doing it myself then I would fill out another for altogether.

Are you trying to side-load at the NVC?

I filed everything with my married name but my passport is with my maiden name. I had no problems with USCIS nor with NVC and I already got a case complete from NVC, so I'd say use your married name if you have evidence of name change (marriage certificate).

Unless those old passport pages had stamps from trips taken together and you were "side-loading" as NLR was asking about, then there would be absolutely no reason for you to send the old passport.

I filed everything with my married name but my passport is with my maiden name. I had no problems with USCIS nor with NVC and I already got a case complete from NVC, so I'd say use your married name if you have evidence of name change (marriage certificate).

Unless your passport is in your married name your visa will be in your maiden name and so will your green card. Costs $450 to change the green card.

I'm sorry I think that I might have misunderstood you. I'm the USC and my husband is from Colombia. Therefore the information I have is for a USC marrying someone from Colombia. All I had to show when changing my last name here is my marriage license both from the notaria and the translated version to change my SSN and when I changed my passport to his last name I sent in my marriage license and translated version and the old passport.

Now my brother in law just renewed his Colombian passport and I believe that its going to take him 6 mths something about them having to send it to Colombia and I think he will be getting a new cedula. But I'm not real sure.

Unless those old passport pages had stamps from trips taken together and you were "side-loading" as NLR was asking about, then there would be absolutely no reason for you to send the old passport.

So, it is possible to get a green card issued with the married name, even with the maiden name being in the passport, as long as there is proof of marriage such as the marriage certificate?
