Okay I'm quoting myself but I just found this link on VJ about someone else in a similar situation and apparently you cannot file MFS or MFJ or married at all if you're doing e-filing when your spouse is a non resident without a SSN. So I'm assuming we're ok with my husband having filed Single.

You cannot e-file, meaning you cannot submit your return electronically to the IRS. You still need to amend your tax return and submit paper copy. The easiest way is to file as MFS and put "NRA" where it asks for your spouse's SSN. However, that also depends on your particular tax situation.

Im waiting for the NVC case number and the thought of amending tax returns with waiting of 8-10 weeks just kills me.

My spouse filed as single and i realized the mistake and was thinking of getting it amended to MFS,but is there a quicker way of getting it in hand?

Don't we have to wait for at least 8-10 weeks before sending AOS packet since we have to include the tax returns in the package.

From the many other posts I have read (this thread and others), it seems NVC doesn't give any trouble about the filing status in your tax form. They are mainly concerned with your income numbers. Saylin has also advised on previous occasions that it is not a big deal unless the beneficiary is from a high-fraud country. I don't know whether India or Malaysia are considered high-fraud. Other members might give more info.

Regardless of what you decide to do for NVC, your spouse should still amend the return for IRS purposes.

Based on your timeline, you should be getting your Case # and IIN any day now. Things will start rolling faster after that. In fact, you should be ready to send your AOS package in a couple of days after Case #. So I don't think you have time to amend your tax return with the NVC AOS package. Just send a copy of what was submitted to IRS (2013 return). For the interview, you can (and probably you should) carry an amended return showing MFS.

That sounds like a reasonable and good idea. Anyway my husband is seeing his tax consultant in the morning and should be able tell roughly how long it would take to refile or amend. But I think I'll let our lawyer send in the stuff we have now in the AOS package just as it is. Really don't want to be waiting longer than necessary!

Hi,

While we are filling out the online form DS-260, we realize that under the tab "Work/Education/Training" (one of the blue tabs on the left hand side), our form only has two items: "Present" and "Additional". The item "Previous" is missing. Without the "Previous", we are not able to input any previous jobs and educations information to the form.

I called NVC about this problem. They login to our DS-260 form and they also see the item "Previous" is missing. They said that the item "Previous" should be there under that tab, but they keep telling me that NVC is not able to fix this problem and they do not know who can fix this.

Does anyone has this same problem? Anyone knows how to solve this problem?

I had the same issue.. Went back and forth but it wasn't there so I figured they either changed it or I also heard that It could be different bc of your country.. What country are you immigrating from?

Sooo.. I wasn't too worried about it until now.. I hope they didn't screw up and I get a checklist for it.. On the other side I printed everything out so you can see that the question was not even available

1) Do I need to send filled DS-260 / confirmation page of DS-260 in the IV packet? If so then I need to wait

2) Documents [Original Birth certificate, Original Marriage Certificate, Photocopy of Biographic page of Passport, 2 passport photographs, Original Police clearance certificate] + Barr code cover letter + fee receipt. What else should be sent along with IV Packet???

3) Can I send IV packet before filling DS-260??

@Koekoe once your package is delivered allow them about 2 to 4 business days to scan your package into their system. My aos has not been reviewed nor approved yet.I would say that entered in the system is to take a place in lane for a review hopefully without check list

I know this issue has come up many times..but im still confused even after reading saylins wiki..

My husband is a born USC..he came here to india in 2010 on a visiting visa..he's been here since then due to some property issues..we got married in april last year..my husband is the petitioner and my father in law is the only joint sponsor..my husband left his studies and job before coming here and so his income is zero as of now..he is still here in india with me..

My question is..

1.does he need to prove his domicile in the US even if he's just here for visiting purposes?

2.if he goes back say tomorrow..he doesnt need to prove his domicile anymore?

3.can my visa be declined on the domicile issue even though my joint sponsor is very well estabilished financially?

Hi everyone, I just have a question about the availability of tax transcripts. My husband just filed his taxes this week since he just came back from deployment. I was wondering how long will it take for the 2013 tax transcripts to be available from the IRS for the AOS packet. Thank you.

First of all NVC does not require that you send them the Transcripts. You could send them a copy of what was submitted to IRS - tax forms, W2 etc. How long it takes to get a tax transcript depends on how you submitted the return. If submitted online, the transcript should be available very soon (probably no more than 2 weeks). On the other hand, if you mailed them a paper copy, it could take 4 to 6 weeks for the return to be processed and transcripts available.

But as I said earlier you should not wait for the tax transcript, and it does not look like you have time to wait for it.
