HI ,

Im getting married in the US in May and then coming back to the UK. He is in the armed forces and I working in the UK.

For being married to a US citizen and myself being a British / UK citizen, which visa process do i go down?

- Do i need forms : i-130, g-1145, g-325a, i-360, payment form and photo ?

- With only just being married what evdience is needed?

- For the evidence of documents do they have to be the real thing or a photocopy?

- From being married do i have to change my name before i can apply for the VISA? Or can i process the VISA with still having my oringal name from before marriage.

- With marrying in the USA, how do i go about making it legalised in the UK? Do i need to go to the embassy or register it somewhere?

What do you need the I-360 for? The rest i-130, g-1145, g-325a, is fine along with your evidence and required documents

With only just being married what evdience is needed? your communication IM's emails, chats, skype letters gifts, receipts, boarding passes anything that shows a bonafide relationship,

- For the evidence of documents do they have to be the real thing or a photocopy? Photocopies only at USCIS.

- From being married do i have to change my name before i can apply for the VISA? Or can i process the VISA with still having my oringal name from before marriage. Nope changing your name is a personal choice. Not required.

- With marrying in the USA, how do i go about making it legalised in the UK? Do i need to go to the embassy or register it somewhere? When you marry you marry. Have you check with UK law and what you need to do. Usually a marriage certificate is recognized all over the world long as it was legal.

I don´t know how the process is in the UK. Probably you will have to go to a British Consulate.

In my case I got married in the US, I came back to Spain and my husband went to the Spanish Consulate in San Francisco to legalise our marriage. It took less than one month.

He came to live to Madrid 3 months later and got his residency here in Spain.

Now, we have decided to live in the US and started the GC process from abroad (Madrid).

I filed I-130 and G-325a forms from here. I didnt change my name (in Spain you mantain your family name). For the evidence of documents you will have to prove you live together. In my case I send the following documents (no need to be original docs):

- American marriage certificate

- Birth certificates (of my husband and myself)

- divorce certificate of my husband.

- passport copies

- lease agreement of our house in Madrid

- 1 invoice of the monthly rent.

- 2 affidavits of bona fide marriage

- i-130 form filled

- g325a forms filled

- 2 passport size photos

2016-08-31 I-751 form sent to USCIS
2016-09-02 NOA 1
2016-10-13 Biometrics appointment

N-400

2017-08-31 Filed N-400 online

2017-08-31 Receipt Notice

If you are taking his last name (optional, not mandatory) and you want green card in married name, you will have to change your passport to reflect your married name. Embassy issues visa in the name that's in the passport.
