The OP already filed through Chicago lockbox.

I think K3 is a valid option. I'm going that route (K3 route). Already have a case # for K3 and it is about to be sent to the embassy for visa processing.

The embassy WILL process the K3 if not just to get the money for the filling fee and I've seen recent example of K3 visas from the US consulate in Casablanca Morocco.

My wife already has all the paperwork ready for the interview. Just waiting for the file to get to the consulate before paying the fees. getting the medical and scheduling the interview.

DS-160 will become available as soon as the file is shipped to the embassy.

OP, unless you are OK re-applying DCF (DCF available and paying the fees again is not a problem), go ahead and file the I-129F for K3. It is free, so you have nothing to lose!!!!!!!!!!!!!!

It's free to file the I-129F but twice as expensive in the long run. To each their own. Have fun!

USCIS is called here on VJ as the 'mis information line'

Do some research, the K-3 has been obsolete for many years

good luck

Take a look at this thread:

I am filing an I 129F for my wife. We already have our receipt of application from the I 130. We are just slightly confused as the form is all based on a fiancé and the instruction form is all related to a fiancé too. So confused as to what info we actually have to include in the pack

Back ground info

Both live in UK now, I am a US citizen from birth, been married for almost 6 years, have 2 children who already have their US passports. We are wanting to move to the US permanently and ASAP

Many thanks for any help / advice in advance

It is okay to file the 129f, despite being married. You'll see on the form that there is a place for the date of marriage. It's confusing, but it's acceptable. I've already filed everything. Let me know if you have any questions. I'm NOT an expert at all, but experience is a little help. Good luck!!

Ok well we got a reply from USCIS, they will not transfer it but we can file another I 130 direct to London but we have to pay again!!! I guess they let you do anything where it means they get more money out of you :0/

We've decided to stick with what we've done and just wait it out :0(

Thanks for all the advice , info x

Really? 4months total vs over a year?

They're not having to deal with being separated, so unless they really need to go to the US, makes financial sense to wait it out.

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.
