stuck in limbo waiting for visa appointment letter!

Hello fellow K1 visa applicants

After doing much research this site seems a perfect place to seek some advice on my current situation.

Basically me & my American fiancée have completed the forms sent to us via our lawyer in the US.

We were told complete the forms then arrange a medical and then wait for a visa appointment letter.

I did the medical in London on the 9th of Jan this year. Now our visa petition status was due to run out at the end of Feb.

We were told by our lawyer that this was plenty of time to get everything done. It wasn't the run out date approached & we didn't know what to do to extend it.

We read on the web that we had to write a letter to the embassy stating that we wish to continue the process, our said we did not have to do this as we only had to bring said letters to the interview with us.

Now the lady at the medical in London said it takes roughly 6 weeks to get that interview letter. I waited 6 weeks for that said letter.

The letter I received was from the embassy but was a letter saying 'we refer to our communication concerning the receipt of an approved petition according your status as a fiancée of a us citizen, as of this date we have had no reply from you. Please respond within sixty days whether you intend to proceed or not'

Now to understand background our lawyer is worse than hopeless he moved from NY to Boca Raton within a few months of instructing him he did not inform immigration he had moved. My fiancée got a letter saying they had undeliverable mail to him, she sent them his new address but we heard nothing from him or them regarding what it was.

The process moved on so we thought it was all okay.

So now after I got that letter me and my finance both wrote letters saying we wish to continue. Plus I explained the whole situation to them.

Now I'm truly in LIMBO as I don't know if the London embassy have seen and acknowledged our letters to carry on the process (did recorded mail). There seems to be NO WAY to contact them if you ring you don't get through to a human and if you do website says they wont discuss visa issues etc same with there email says don't contact them regarding this.

Called the National Visa centre in the US and they just said its nothing to do with them now as they have approved and passed to the embassy.

Plus I have paid and done my medical so don't know if they have that information I was told It gets sent to them?!

Its been 9 weeks since medical please I need help I don't know what to do no one seems to have answers.

Also if i type my case number on https://egov.uscis.gov/cris/Dashboard.do it says cannot find it, im sure when i checked it before it gave me a status.

Please can someone advise me on my situation at my wits end :(

I received the same letter and responded to the embassy in writing stating we still intended to continue with the application, I also had my fiance do the same thing and I have a new letter of intent from her to take to my interview.

How long ago did you send your letters? I received a reply from them after maybe two weeks explaining what to do next.

Did you complete this http://london.usembassy.gov/iv/notification_of_applicant_readiness_form.html after your medical, this could be what the embassy is waiting for from you.

I agree with Broe, review the guide and double check that you have completed and submitted all the pre-interview requirements, including the London Consulate Application Readiness Form.

Also, for status updates for the NVC and Consulate stage of the process requires going to a different website (not the USCIS site). You can check the status of your visa by entering your NVC Case Number on this site: https://ceac.state.gov/ceac/

Hopefully now that you and your fiance are back in control and making contact with the Consulate things will get resolved quickly. Good luck.

I haven't seen or been told to fill that notification of applicant from have done everything else so maybe it is that, that's holding us up!

Glad we could help! That guide I posted the link to is the most useful thing I've ever found relating to the k1 process in London.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

You mean "Comrade Wheatley's Domain", T-B... ;)

And this is a prime example of why you don't use a lawyer. There are many tales of lawyers sending the wrong form, not sending forms at all or otherwise screwing things up. The only time you need a lawyer is if you require a waiver of some kind or you have to go before an Immigration Judge. For a straightforward K-1, all the information to do-it-yourself can be found here.

I was under the impression that if you're filing from the US and not DCF then the NVC schedule the interview date and I do not fill in the letter of readiness form!?

I am doing CR1 not K1 so maybe thats the difference?

Submitted my readiness form in early Jan (4th I think), had my medical on 13th Jan and got my interview on 11th Feb. Fairly swift. I gather that the visa process is kind of seasonal, with summer being high-season, so the closer you get to summer, they slower the processing times get. If I am wrong about that, please correct me, but it seems to be the case!

Just for the sake of clarity, you can submit the readiness form before your medical takes place. You just have to have made an appointment to submit the form, not actually have attended. I know this doesn't change your situation here, but worth nothing for other members.

So when I completed the form I got this message-

Thank you for submitting the forms in support of your visa application. You should allow 6 weeks from the date of receipt of this email for the Immigrant Visa Unit to contact you with further information concerning your application. We regret that we will not provide status checks during this period.

If the circumstances of your application changes during this time, for example:

  • Change of address;
  • Change of Marital status;
  • Death of petitioner; or
  • Birth or adoption of additional children.

You may email us through the Contact Us page of our website.

In your guys opinion does it usually take 6 weeks or is it longer or shorter than that?

All that means is "Don't keep asking us when your date is, we won't tell you" - contact them only in one of those four situations.

Of course, that doesn't mean you can't ring the NVC in a couple of weeks to see what date you've been assigned. And ring them here and there, unless your interview letter comes in first.

Edit: To answer the question.. it varies, but usually they've been quicker than that. They certainly were with me.

My fiance and I had the SAME exact problem with the notification of readiness. We sat for 5 weeks hearing nothing until we were browsing VJ a few days ago and heard about it. I learned from the Embassy that you have to check your status on CEAC as an immigrant visa. So that would be with your LND number. Once we did that our case was updated 2 days in a row (the day after we submitted the form and the day after that) I'm sure your letter is just around the corner, as is ours! hold tight and stay positive! :)
