You will be okay 2nd time around. I have been through that. But make sure you attend interview. They deny more people that don't attend interview at this Embassy. If you can, visit a few countries with your wife like Thailand or Malaysia. That will make your case lot more strong. We visited multiple countries together. Same airlines same hotels etc. Visa stamp on passports same date big help. We had all those evidence on our first interview back in 2011 as K-1 as well but was still denied. They actually never tell you exact reason why they deny as some people asked here. They never can tell you the exact reason because they can never be sure 100%. All they tell you is they have reason to believe the relationship is not real. We are still wondering why our case was denied back in September of 2011 but looking back at it now, I can just assume that looking at our petition, they actually pre determined that they would deny visa anyway. Here is the trigger point of denial based on many interviews I witnessed in 3 years at this Embassy: I spent 3 whole days inside Embassy witnessed many interviews. Overwhelmingly the number one reason for denial is getting engaged or getting married on first visit. No matter how much evidence or how many visits thereafter, doesn't matter. They will ask and ask and ask and focus on that point. How could you get engaged or married to a person of your first visit? How could you? Just few days after meeting for first time? So these days I tell everyone don't get engaged or married on your first visit. Take your time and do it on your 2nd or 3rd visit. If you commit to each other, you will succeed eventually. No one can deny you to be together. After going through everything at this Embassy, K-1 and I-130, I consider myself an expert. I will be happy to help or answer any questions. Good luck

Hello, My fiance (Chinese National) and myself moved to Cambodia June 2013 after the Taliban ended our employment in Afghanistan. My Fiance is going to China soon to obtain necessary documents such as Birth Certificate, husbands' death certificate,police certificate,permission to marry certificate. After her return from China I plan to file the 129 /K1 fiance petition in May 2014 when I visit family in the US. I list her mailing and residence address as S'ville, Cambodia. My residence is also listed as S'ville on the 129 and when I filed my 2013 taxes. We should have sufficient proof of relationship- 4 years of travel visas and work visas together and photos.

Question 1- Do you think US Embassy in PP will process our petition? The US PP embassy states that they process all visas for residence of Cambodia. We have been here for almost a year now.

Question 2- Can you think of any other documentation that the US Embassy in Phnom Penh may want from my Chinese Finance?

Any input wll be truely appreciated.

Not sure US Embassy process application there directly since you live there. You can contact US Embassy by email or by phone or can just stop by. Usually USCIS process everything but the interview. Better to contact them directly for information. You can also ask them if they require anything else from your fiance since she is a Chinese national living in Cambodia. You have to follow her local law whatever it is. US Embassy follow Cambodian local law. Cambodian local law prohibit marriage to a foreigner who is over 50 years old and also need a minimum monthly income of US$2600. US Embassy strictly follow local law and customs. Since your fiance is a Chinese citizen living in Cambodia, I think you need to follow her local law. You better contact US Embassy in Cambodia before you apply. Some Cambodians applied without knowing local law. They may get approval from USCIS easy but always get denied visa for not following local law.

Question 1- Do you think US Embassy in PP will process our petition? The US PP embassy states that they process all visas for residence of Cambodia. We have been here for almost a year now.

The Embassy will not process your petition, a USCIS service center in the US will do that. If your fiancee holds legal residence in Cambodia, then she will be able to have her visa interview in Phnom Phen.

Hi and thanks for the input. My Fiance is headed back to China in a couple of weeks to obtain some necessary documentation for the 129 petition.

Do you know if China has such a document called "Permission to Marry" ? She was married before and her husband died. We know she needs death certificate with English translation but she thinks there is a permission to marry document. If such a document is needed do you know what office in ShenYang she would have to visit?

To answer your question, I have never heard of any "permission to marry" document from China.
