Hi Everyone,

I just wanted to ask your opinion about my situation,

I was a K1 holder when I entered the US last year. I got married with in the 90 days. Stayed the US for almost 5 months then went home (Philippines) with out filing AOS. My husband wants me to travel back to the US, so he is planning to file a K3. I am married to a US Citizen, I already have my SSN and I am included in his ITR already. My questions are, would there be any problem if my hubby filed for a K3?or CR1 is still the fastest? He already called the USCIS and the person whom he talked to, told him that K3 is the right petition to be filed so my husband will be submitting the documents next week.Thank you.

Cr1 is the superior visa. You get a green card upon arrival to the USA and you dont have to file AOS.

They take about the same amount of time and the K3 costs twice as much.

Our attorney told us that K-3 has pretty much become obsolete at this point. It used to be a faster way but it no longer is. CR1 might be the better bet.

11/02/2011 - Day 17 - Biometrics letter received, biometrics scheduled for 11/22/2013
11/06/2013 - Day 21 - Successful walk-in biometrics done

11/07/2013 - Day 22 - RFE related to the I-485/I-765

12/24/2013 - Day 69 - Sent in requested evidence for the I-485/I-765 RFE

12/30/2013 - Day 75 - Status of I-485/I-765 changes to "Evidence request response review"

01/06/2014 - Day 82 - EAD approved (81 days)

01/13/2014 - Day 89 - EAD card received, issued on 01/06

01/21/2014 - Day 97 - Received interview letter for I-485; interview scheduled for February 25th

02/25/2014 - Day 132 - Interview at Federal Plaza USCIS location (admissibility not determinable, officer requests I-130 from Nebraska Service Center)

03/26/2014 - Day 164 - InfoPass appointment at Federal Plaza USCIS location. Handed I-130 approval notice to Immigration Officer

03/27/2014 - Day 165 - I-485 approved. USCIS case status website shows card production

04/04/2014 - Day 173 - Green Card received!

Some k3s are being processed, mine included. It has been received by my embassy and I have already filled out the oline form, ds160. Will be scheduling my medical appointment tomorrw and hopefully get my interview appointment soon. 130 is still at NVC, no case number yet.
