I-693 for AOS

Hi guys! After reading a plethora of forums & blogs, I have come to a conclusion that SLEC always leaves the rotavirus row blank in the DS-3025! and then after further research, I found out that it's only administered to ages 2, 4 and 6 month olds, with max age of 8 months! (Anybody can correct me here if I got that wrong.) Seriously, why can't they just label it "not age appropriate" for adults!! girlwerewolf2xn.gif

Anyway to cut the story short, I have decided to look around for civil surgeons in NJ, only to find out that they charge around $250 - 350! Even if I kept insisting on the phone that I only need my DS-3025 transcribed to an I-693 vaccination part (which is the last page only), they keep telling me that I need to do the whole medical! huh.png ... called up 10++ CS clinics just to hear the same 'ol blah ... I know it's a risk to take if one only submits the DS-3025 for the AOS, but I'm very tempted in doing so. Now I'm curious, has anybody here received an RFE for not submitting an I-693?

I will assume you are referring to the AOS petition and process. Yes, you have to have a completed I-693 included with the package or you will definitely get an RFE. I am sorry to hear about the CS charges you are running into. To help keep my gal's charges as low as possible she went to the local county health department and got any and all vaccinations and immunizations needed. She got 2 shots the MMR and something else, I forget. She took the form given to her from the county health department and that was all she needed for the CS. The CSs office just filled out the paperwork, the CS signed it, and we were gone. But, I am also sorry to tell you that we got all this done at the CS's office for $0.00.

Well actually that isn't true, I know it happens but it is not what is required per the I-485 instructions, page 4 section 7C: All that is required is a copy of the DS-3025 vaccination record if AOS is filed within a year of the medical.

I know of others who have had no issue using the DS-3025.

There have been a few isolated instances of people receiving RFE's when they did not submit an I-693. It was probably due to a USCIS newbie handling their case. The vast majority of people simply submit their DS-3025 and have no problem because that's what the I-485 directions call for.

If you decide to have a civil surgeon transcribe your DS-3025 onto an I-693 anyway, you shouldn't pay more than $30-40 for the service.

Suggestion - make a copy of page 4 of the I-485 instructions, highlight section 7 c and staple it to the DS-3025 vaccination record

Ok, Hank I will have to give this one to you. When my gal did the AOS thing in 2010 the I-693 was required. The rules have changed since then.

Does the petitioner do this "in anticipation" of receiving an RFE?, or in after thought, do this "instead" of submitting an I-693? If my memory slips me, the USCIS has their own way of interpreting the regulations, hence, the "undisputed" denials. Hank, I do appreciate your desire to stay up-to-date,

Actually the rules haven't changed. Like said by others - some adjudicators are not very well trained and expect to see an I-693, when they see the DS-3025 they go to stupid mode and issue an RFE .

The petitioner is not filing AOS ;) The beneficiary is. :)

My suggestion of attaching page 4 of the instructions with section 7 C highlighted is to "cut the RFE off at the pass" in case you get an under educated adjudicator. There is no interpretation, the instructions for the I-485 are very clear - only a vaccination record is required if filed within a year of the medical.

Thanks for the helpful insights, guys! :) Ohh, the paranoia that SLEC leaving the rotavirus row blank brings! Instinct would say that since this medical/ DS-3025 is the same that all family-based visas are submitting too in their AOS ... the K1s should be cleared from this limbo ... Ohh well.

I just hope that one day SLEC would realize that them missing a simple detail could cause such a major oooopss! headbonk.gif

SLEC follows the guidelines dictated by USEM

I don't think not ticking or skipping a vaccination item is following guidelines, Hank. This is obviously not conforming to standards and can be a serious issue of non-compliance to CDC standards and is auditable.

- so you are saying that you believe SLEC is not following the guidelines from USEM and are doing as they please and USEM, along with CDC, are turning a blind eye?

Easy, Hank. I didn't say and never said they don't. no0pb.gif But human errors are very feasible. Keyword is, SHOULD. They SHOULD follow USEM and US CDC guidelines, including not skipping any vaccination item, considering the applicant followed all the instructions during the medical and paid the corresponding medical fee.

Saying that, I know how difficult it is to be comply with international standards. But it just makes one wonder how often does USEM do the audit on SLEC? I will be surprised if you are not an advocate of improvement. And certain administrative errors like this is something worth raising, IMHO. After all, it's human to make mistakes. But this small mistake costs $$$$.

There's no logical reason why the rotavirus row be left blank in a DS-3025. Unless anybody can think of one, I still believe it's a very serious non-conformance to USEM standards/ guidelines.

I don't believe SLEC is skipping any vaccination that is required. Every medical file is reviewed by USEM, all vaccinations given are listed there, if there was a required vaccination skipped it would be caught, and if it was a flagrant issue SLEC would be jerked up by their boot straps.

With all of that said - none of the vaccinations are required, you can refuse to get any of them, of course come AOS time they would be required.
