We don't have 2012 Joint tax

Hi everyone. We did not have joint tax for the year of 2012 because my husband arrived here in US last sept 2012. He lived oversea for two years with me. He petitioned me through DCF. And I arrived in US last Oct 2012. We did not find a job immediately.

1. Is it alright if we dont have 2012 joint tax? We will just write an explanation letter why we dont have the tax transcript.

2. We are going to file joint tax for 2013. But my question is, can we file married jointly although we worked as independent contractor or self employed?

Doesn't really matter if you have joint, or file separate, as long as you put that you were married and not single.

I-130 STAGE

16th May 2013- I-130 PD Date
30th Dec 2013- Transferred to TSC
13th Mar 2014- I-130 Approved
20th Mar 2014- Cased shipped to NVC.


NVC STAGE

28th Mar 14 Case received at NVC
28th Apr 14 Case # & IIN assigned

13th May 14 AOS package scanned into the system
14th May 14 DS260 available/completed.
20th May 14 IV package scanned into the system

12th June 14 AOS checklist- NVC error-

13th June 14 Supervisor review, said she would remove it when spoke to her. (Up to 30 business days).

28th July 14 CASE COMPLETE!!!!

19th August 2014- Medical

5th September 2014- Interview @ London

05th Sep 2014-Interview

05th Sep 2014- APPROVED! Visa Status Issued same day!

10th Sep 2014- Visa in hand

18th September 2014- POE ORLANDO FL! DISNEY!! :dancing:

why not file for 2012 anyway? Might be some monies coming back on ya.

Thank you for the answer. What I was trying to say, he did not file tax for the 2012. I am sorry for the confusion.

I dont know to my husband since on that time he just got back from my country. I am worried because I have been reading that we need 2 years of tax transcripts. But unfortunately, we do not have the 2012.

Is he US citizen? Usually you are require to file a US tax return for each year if income is even made in a foreign country. Just get him to file for a 2012 anyways as Darnell says.

Hi Darnell, is it alright if we will be filing late? What form should be used if he has not produced any income at all?

Yes he is a US citizen. He did not make any money in foriegn county so no income at all.

It is perfectly fine to file late - if the feds owe him money, is no penalty and will get an extra interest payment.

So, without earning income anywhere on the planet, go ahead and WORK ON THE PAPERWORK for 2012,

you work on it - see what's what, see the scenario at 'married filing jointly' . I not say to file it, yet - I said for YOU to work on the paperwork,

with the hope that you'd report back what's what when yer done, finding fun IRS tax thingies that has the feds giving you and your husband monies.

At least, that was my hope. Tax forms and tax code can be fun, if you take the right approach of 'wow - they will give us money if I know what to do on this form !'
