Do we qualify for expedite?

Hi All,

I've been looking through the forum and I haven't found a clear answer to my dilema...

This is the current situation:

- I am the beneficiary and I recently got a letter from my employer stating that my job is being made redundant in a month or so.

- My wife (the US citizen) is currently unemployed and we are living solely on my earnings.

- She has a job proposal that she will be able to take once we move to the US.

- Between my redundancy date and the eventual move date we will be living on our savings (and thus draining them down).

Would the expedite on the basis of financial loss apply to this scenario?

As you said, you can live in savings. Just because you don't want to do that doesn't mean expedite.

What job is waiting for her? Why can't the USC move now and take the job?\

She doesn't need me in the US to take the job.

The sole reason why she doesn't do so can be resumed to one word: Love. For us, being apart from each other more than a day is inconcievable, even if just in thoughts. I'm sure you can understand that.

Anyway, the question here is regarding the change of my situation and not regarding the job oportunity she has. But I'm guessing that your answer is going to be that USCIS couldn't care less if I am losing my job or not... :(

if losing a job got people expediated I think most people waiting would arrange to get fired to speed things up. Sorry they don't care. Do you have a co sponsor in the US lined up ?

You have a point. Too bad that the auto-expedite of cases submitted from abroad no longer seems to apply.

Too bad things don't work the same way it works in europe where the priority is to keep families together and where there is such a thing called service levels...

Regarding the sponsor part, yes, we have that covered.

Not to be rude, but there must be something about immigrating to Europe you didn't like or you and your wife wouldn't be returning to the U.S. The sheer numbers of people wanting to immigrate to the US make it a more cumbersome process, sorry.

Hi jan22. No offense taken.

I didn't immigrate to Europe, I am an European citizen. The only reason my wife immigrated here was so we could be together. The reason why we want to go to the US is because she is homesick and misses her side of the family nothing else.

Also, I'm sorry if I offended you in some way, that was not the intention, nor it was to badmouth the US in general. I was just ranting about this process that keeps getting the timelines extended more and more and in the process hurting the many US citizens that are kept apart from their loved ones by it. We consider ourselves lucky to at least being able to be together while this process goes on. Many are not so lucky and keep seeing the time that they have to be sepparated from their loved ones getting extended further and further and I empathise with them.

What auto-expedite are you talking about?..

Also, one would think if you're both in the same country it's a tad easier than for people who're in different countries, eh? Not that i don't sympathize with your not being able to be apart for a day.

I think you are way over-generalizing about European immigration. Two words: Danish immigration. Yep, there are European countries that could care less about families too.

Yes, it is difficult being apart from a spouse, but I doubt you'll be granted the expedite on these grounds.

The expedite is for the USA citizen, she is choosing not to seperate and take a job... And being that ou are mot a citizen, at this point your unelmployment is notmtheir comcern. There is no outstanding medical or other issue that is preventing Her from coming back. so i think you are out of luck expedite wise. And like Nola said, not ALL European countries are so wonderful about immigration... I can tell some stories about the Italy and Swiss systems... But good luck

Off topic but since you don't have a job and your spouse unemployed are you going to be able to meet the income requirements when submitting I485? Just something to be ready for so you don't end up delaying your case at NVC.

I-485 is not part of the IR1/CR1 process.

Short story: No.

Also, if she's not working in the US, I think you're going to see some problems with the I-864.

OP has already explained that they have a joint sponsor.
