No lease agreement but been living in our apartment for more than a year

Hello. Is there any possibility to replace this option? Our landlord did not issue a Lease Agreement. Can he just write a letter that we are his tenants instead of lease agreement? Please help me.

Absolutely. This is normal, that some landlords don't ask to sign lease. Just ask him to put down his details and whats the rent amount, since such and such day you live there with your spouse and sign it. I suggest also to have it notorized so there will be no questions, no more.

Are you concerning about ROC?

For ROC I think yes,the letter signed by landlord mentioning him as property owner, both your names as tenants and the date since you have been living there is fine.I am not sure whether it should be notarized or not(or if we are not supposed to submit non notarized statements) but i think if it is notarized then its excellent.

Basic pillars of ROC are

1.cohabitation

2.comingling of finances

3.social life together

Cohabitation can be proved by lease or affidavit by owner of house stating you both living there.

It can also be proved by common address on IDs,w2 forms,address on individual credit cards,letters received at home addressing you both separately or together or any other of your individual document stating common address.

Looking at your POE i think you still have around 6 months to collect and maintain docs.smile.png

Card received at home (DAY 102)-6/03/2014

I have no lease just a month to month tenant. I got my landlord to write a letter stating how long we have been living here that we are on a month to month tenancy and that we are in good standing. It worked with no problem.
