G-325A - Signed Copy (oops?)

Hey all:

I was just posting in another thread and was told that a copy of the G-325A filled out by my UK fiance would likely not be accepted. I thought that everything except the I-129F form could be copies, since nothing on the G-325A directions (at least that I read) said it had to be original....so I only freshly signed the I-129F and my own G-325A. But his G325-A was a perfectly scanned copy that was signed. Will they accept this, do you think? Or, if they don't, are we just looking at an RFE for an original copy or are we looking at a rejection/denial of our entire petition?

I had no idea and now feel so worried and foolish.... any advice = very appreciated. Grrrrr.

Not a denial of the entire petition. Likely scenarios:

> RFE. You'll be asked to send in a signed copy that isn't scanned.

> USCIS accepts. They might not notice that it's scanned.

> USCIS accepts but notes the mistake. They'll ask your fiance to sign it during the interview.

I understand how worrying and stressul it is. I'd be losing my mind if it happened to me.

:( thanks--you also let me know of the mistake, too! Thank you for the experience and compassion. This is an incredibly emotional process, and I am a perfectionist so it eats me alive in a way it doesn't my fiance. I am so mad at myself! Here's to hoping they just won't notice....

You have a lot more immigration forms ahead of you in the next few years, so keep in mind a rule of thumb---

Forms and Letters (of intent or employment) are signed in ink

Documents mailed can be photocopies, but originals of them will normally be taken to interviews to be seen in person.

If you read the Stickies at the top of the forum you'll read where sometimes USCIS accepts a scanned copy of the G325A form...but you'll also read where they do not.

I'd merely wait but get a signed copy from your fiance. Read the Guides and follow them to the letter (along with the form instructions).

The guides may indicate more than you'd read from the instructions....that is because they are the compilation from many folks over many years of what works.....

Yes-- all too sadly I didn't see that before I filed. I didn't write our names on our photos either or location, though I did attach a date stamp. I also used a scanned copy of intent from my fiancé. Can you tell me which link here gives examples of cases where they accept?

Also is it true these little mistakes won't cause a rejection but an RFE? Will I get RFEs for not having written on my photos for example?

Oy. And I thought I did everything possible.

An RFE is more likely on a document not signed than on Photos which are secondary evidence anyway. Don't beat yourself up. It's done. If you get an RFE, then submit what they say you need and your case carries on. You won't know until an RFE letter comes in the mail. Meanwhile get the form and letter you suspect might be needed so you can be ready to submit it when/if a letter comes.

I had the exact same problem!

I received the whole package back, with a notification saying:

' was not properly filed because the application or petition was not signed. Therefore, we have rejected your case and returned it to you, including all supporting materials. Please review the instructions on the rejection notice you received prior to re-submitting your case'

We sent the package back with everything signed correctly. After we sent it back they accepted it within two days and everything was back on track!

Good luck!

Oh no! That sucks sad.png my I-129F was wet ink/original signature...but they may send the whole thing back sad.png Did they already cash your check/did you have to re-pay the $340? And, if you don't mind my asking, how long before you got the notification of the rejection? Did you have to wait a couple months for an RFE type thing like everyone else or was it pretty much immediate? Thanks :/

I'm pretty sure, everything was originally signed except the G-325a, which was a scanned copy! (we had realised it might be a problem so I sent him a original signed copy a week before we got the rejection notice)

I don't think the cheque was cashed, we just sent it back and I assume once they re assessed the paperwork they cashed it. :)

They received our package on the 17th and It was returned on the 27th, dated the 23rd. So it wasn't much of a wait, which is surprising! I personally didn't see the returned package but I'm pretty sure my fiancé said all the paperwork had barcodes and looked like it had been inputted onto the system, it had case numbers and whatnot on it. We sent it back the next day and it was approved on the 4th. So even if there is a problem, it can be sorted out quickly! :)

My heart absolutely sunk when I was told we were 'rejected', but honestly it's nothing to worry about with regards to this situation!

If something is blatantly wrong with the submission (like wrong payment amount, check made out to wrong name, no G-325A form, no signature on a form) ...instead of giving a NOA1, the contractors will send it all back including the check and tell you to fix it. So you sign the form or write a new check or whatever, and it's like you are starting over on a new filing date. Then you get NOA1. If your check was correct, you just put it back in the package.

If it is something an actual USCIS officer evaluates about your case, that will come later and they don't send the whole thing back. They send a list of what evidence they are requesting.

So...if you get a NOA1, it is accepted. If an officer notices the scanned form looks dodgy, he could ask for another later down the line.
