I551 pending for 3 years

Hi everyone,

I am new to this site.

I have my I551 pending since 2010 OCT until Now (2014 Jan). Currently it is still pending.

The following is some information about my past.

2008 Feb - Married with my ex husband. He is US citizen

2008 Oct - Got my Temporarily Green Card

2013 July - Filed divorce. He has been treating me bad.

2013 Oct - Interview for Official GC. They took my Temporarily GC back.

Is there anyone encounter this kind of situation before?

Would somebody please give me an advice how should i move forward?

What do you mean by temporary green card and official green card? Do you mean conditional (2 year) green card and interview to remove conditions or do you mean stamp in your passport (which is what your post implies) and interview for physical green card? What visa did you enter the US on?

I am confused because you say you got your temporary green card in 2008 and interviewed for your permanent green card in 2013. The temporary card (or stamp) is only good for 2 years.Maybe you meant you went for your interview in 2010? This would make sense if you have been waiting 3 years as your post says.

If you interviewed in 2010 you need to call someone Monday, first thing, or make an info pass to find out why you haven't received your new card. Why have you waited three years to inquire?

I am sorry. What i meant Temporarily GC is the conditional (2 years) GC.

The CGC expired on 2012 OCT.

I entered the US on visitor visa.

They sent me a mail about the interview at 2010, i did not receive it. That's why i missed the interview.

Immigration reschedule again on 2013 Oct. They took my CGC away and stamp I551-pending on my passport.

I have make an infopass and they told me to wait for the results.

Is there anyone had similiar situation before?

July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

it's a Human at USCIS that will finish adjudicating your application.

There are other Humans at USCIS that can assist you with finding out exactly what's going on.

Getting a Human at USCIS is important, sometimes.

I didn't personally experience this situation but I've seen some people who are similar in your situation who sometimes have their Conditional GC taken away after the interview and got approved. Did the interviewer said anything to you or how long you have to wait to hear back from them? I think others had said 30-60 days? Or even 90? I don't know but may be a good idea to call USCIS and find out.

What Darnell is saying there is you need to reach a person at USCIS. There are a lot of longwinded automated messages in the phone system and one can get lost in there. However, instead of just "Human" you need to speak with a Tier 2 officer. The first person you will always get is a customer rep who reads off a script. If you need specific details on your case you need to stand firm and make sure you ask for a Tier 2. I think they have a policy that they don't always send someone through to a Tier 2 because many people just call for random questions that are already readily available and they want to make sure to free up Tier 2 officers for special cases like yours.

4/24/13 - Submitted I-751 application

4/26/13 - I-751 officially filed

6/11/13 - Biometrics done

8/14/13 - Rec'd RFE

9/21/13 - Submitted RFE response

9/23/13 - RFE response rec'd at VSC

(about 2 months later)

11/21/13 - Service request via Tier 1 submitted

12/11/13 - Response to service request rec'd - vague info about processing times

12/12/13 - Service request via Tier 2 submitted

12/10/13 - APPROVED!!! (letter rec'd 12/14/13)

12/16/13 - 2nd Service request response rec'd

12/17/13 - Card production email/text rec'd (online case updated)!

12/24/13 - Notification rec'd via email regarding card mailed on 12/23/13 (online case updated as well)

12/26/13 - 10-yr card rec'd!

One thing I have learned on this journey:

There is no such thing as an "overkill" evidence package. Submit anything and everything you can. Who knows what will prevent you from getting an RFE.
