Taxes - Married and Filed separately or jointly???

Hey guys...,

Well here is the deal.

I send in my paperwork for ROC in November.

What impact would it have for my ROC if we file married but separately?

I mean to be honest....it makes a huge difference on our income taxes since my two step kids are living with us.

I am very happy for any help.

If you've already filed to remove the conditions then how you file now doesn't matter. The information they will review they already have. The decision will be based on that.

Thank you so much for your answer. It was just a big shock what difference it makes from filling jointly and filling separately.

It's a huge difference of over $2000.

Let's say for example, I get an RFE or have to go to an interview and all of a sudden they want the taxes from 2013. You know what I mean?

The word "married" says just that. It doesn't say single or head of household. I filed my 2012 married filing separately but the current one I filed jointly. Ima send my paperwork in next month.

Day 0 (Mon, 1/23/12) Package mailed

Day 12 (2/4/12) Hardcopy received in mail for Biometrics Appointment due on 2/27/12

Day 14 (2/6/12) Walk-in biometrics done

Day 47 (3/9/12) Hardcopy received in mail interview letter date April, 10 2012 @ 3:15PM

Day 73 (4/4/12) Received EAD

Yeah we filed the last two years jointly but the Income changed big time in one year and it would be just stupid to file jointly again.

All our US tax returns to date were married filing separately (bigger return). Removed conditions with no problem at all, went very quick.

As long as you filed as married, filing individually or jointly doesn't make a big difference, as long as you can explain why you filed individually. Remember you can have one utility in each name with the same address - the utility need not be in joint name.

The bottom-line is to prove that you are married, living together and have inter-mingling of finances - .so if you have joint bank account, then individual filing of taxes in married status for saving taxes is absolutely fine. just explain in the covering letter - in your case if you get a RFE.

USA

01/08/13 - Approved and GC is order for production on 1/8/14

09/12/13 - Case transferred to CSC. NOA2 received on 09/18/13

08/30/13 - Biometrics Done - No walk ins allowed at this LSC (received on 8/16/13).

08/05/13 - NOA1 (received on 08/10/13)

08/01/13 - Mailed I-751 (received on 8/2/13 - check cashed on 8/5/13)

12/28/11 - Received SSN (applied on 12/20/11, as we didn't get based on DS-230 options)
11/28/11 - Received Green Card (Expires on 10/30/13) - Welcome Letter on 11/17/11
10/30/11 - POE - Houston, TX

Chennai Consulate (40 days)
10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.
