I751 Denied due to no response.

Hello, I'm asking these questions on behalf of my wife. I'm currently stationed at FT Hood, TX. We came here approx. 3 years ago. We filed everything within a timely manner. We didn't send adequate information proving our marriage to USCIS. So they mailed us another letter asking for more evidence. We gathered more from joint bank accounts, to letters of ownership from a vehicle we share. Even had everything notarized by USAA. We had it sent off late OCT by overnight delivery and kept the receipt. The evidence was due by NOV 17. I just received a letter stating that we didn't respond within the allotted time period and that her status has been revoked as of the date of the letter Jan 9, 2014. Should I seek the help of an attorney or should we just attempt to motion with a form I290b. Being an infantryman my patience and wallet are growing very thin with all this USCIS #######.

I do not know much about it, but there is some help available to service members through the military. There is also a forum here for miltary applications. Check it out and see if there are some answer there for you.

actually,

you can talk with an ISO at USCIS via telephone,

and THEY can chase down the RFE packet that you submitted,

and THEY can request it be forwarded off to the Adjudicator that wrongly denied the ROC case.

It takes some phone time, during the day - suggest you talk with your foreign spouse to make the time to talk with that ISO, if'n your duty time conflicts during the day.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
