Blue Sheet Question - After K1 Interview

Hello everyone,

I just finished my interview at the HK-Emabssy and everything went well (or at least I think so).

The officer had everything checked off, including sponsors, police certificates, translations etc.

Here was the problem: As I am currently on a trainee program (state-funded) I can not leave Hong Kong until the 30.June.2014.

Reviewing the medical exam, they said that I have to enter the states until 25.June.2014.

When I told them that this would not be possible, they gave me a blue sheet to take the medical exam again and therefore extend the expiration further.

I was also told that I have one year to send everything back.

My questions:

- Is it really one year valid or does the date on the approved I-129F madder?

- Is there anything important I need to remember?

- Is it likely to get denied even at this stage now?

There was nothing mentioned about any other concerns or questions about my case, my fiancee was even waiting in front of the embassy (she is visiting) to proof our point! dancin5hr.gif

The date of the I-129F petition expiration makes no difference in the expiration of the visa itself. The K-1 visa typically has an expiration date that linked with the time of your K-1 medical. If your medical was in Dec., then you would need to use the K-1 visa to enter the US by June, as the CO was explaining to you. If you need to enter later than June, the CO gave you an opportunity to extend your K-1 visa validity date by getting a new medical. Once you get the new medical and submit it to the consulate, then they can issue your K-1 visa that will have an expiration that is 6 months from the time of the new medical exam date.

The expiration of the K-1 visa is solely for the purpose of entering the US. Once the K-1 is used to enter the US, it becomes null and void. Your status in the US will then be based on your I-94 and you will have 90 days from your entry date in which to get married.

Also, does it madder if my I-129F was approved on 2.Oct.2013 and will expire on 2.Feb.2014? Will I need to send in the medical before that? or is that not of importance as of now?
