Timeline

Question… I have my petition denied by USCIS and I received a letter today. I knew this was coming. The basis for the denial is the lack of meeting my fiancé in the past two years at the time I petitioned. I put a waiver request at that time but I didn't meet the standards of the waiver I guess. It is a long story. Back to my question, am I eligible to file right away (I meet all the requirements now BTW)? All the letter talks is how to appeal the case which I don’t have a plan to do that. I am wondering if I needed to respond to USCIS first with a statement I don’t intend to appeal. I don’t know if there is any timeline when one would need to refile after the first petition is denied.

If you meet all the requirements then go ahead a file a new petition! Include any new evidence you have gathered along the way! Good luck to you :)
