Is my petition going to be denied?

Hello,

I'm getting ready to submit a petition for my wife but have a concern that it may get delayed or even denied because I got married two months after my divorce was final. Here is the situation:

1- I got my US citizenship through marriage to US citizen. My marriage lasted 5 years and two months. I got my US citizenship in 2012 because I was married for 3 years at that time.

2- my first marriage was real and my USC spouse wanted the divorce. We had a child, joint bank accounts, always lived together, assets, insurance, etc.

3- I wasn't planning on getting married initially but after I was seperated and before my divorce was final I met a girl in Jordan and we kept talking on the phone everyday after I came back to the states, we loved each other, and decided to get married.

4- finally, we got married two months after my divorce was final.

My question: is my petition going to be delayed or denied based on the facts above, should I include a cover letter to explain this with petition, or just wait and explain things if they ask? Any feedback would be appreciated especially from people who had similar experience.

A delay or denial of said petition based solely on the reasons you gave is not likely. However, your wife at the visa interview may be asked many questions about your prior relationship.

June 17, 2010: Arrived for second in-person meeting and start of travel together to other areas of China!

December 8, 2010: Wedding date set; it will be on February 18, 2011!
February 9, 2011: Depart for China
February 11, 2011: Registered for marriage in Wuhan, officially married!!!
February 18, 2011: Wedding ceremony in Shiyan!!!
April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Thanks Ryan H. What kind of questions do you think my spouse will be asked about my previous marriage?

Any other inputs from others would be appreciated.

Agree with Ryan.

I would include a brief cover letter explaining it was your ex who wanted the divorce and that you were separated a while before you started seeing your current wife. Your current wife may be asked questions as to how long you were married, the name of your ex, why you got divorced (and they may try and trick her here, and imply it was your fault or some such), when you got divorced, details of the custody arrangements of the child, and of course lots of questions about the child, have they met, name, school etc etc.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Probably not- but it helps to point out you didn't "dump her" as soon as you got citizenship so you could marry someone from your home country.

Thank you penguin-ie. Does it really matter for USCIS who wanted the divorce? I'm just curious how they look at things.

Don't worry you will get approved, we got married 3 months after his divorced was final and they approved us 74 days of waiting. Stay positive :)

Wow. That was a quick approval. Is your husband a natural born citizen or did he get his citizenship through marriage? Thanks for the info.

Natural born citizen, we live together though maybe it's one of the reason why we got approved quickly
