Anyone here tried sending an email to the Office of the Ombudsman??

Hello everyone!

I just want to ask if any of you here tried sending an email to the Ombudsman for a case assistance due to a USCIS mistake? Can you share your experiences please?

I sent an email today and I am hoping that they will respond to my email as soon as possible.

Our case problem is this (the same with what I emailed to the Ombudsman):

1. We received a Notice of Action Form I-797 from USCIS stating that our case has already been approved. (Please see attached file for the copy).
2. The approval notice additionally states that the beneficiary (Me) is RESIDING in the U.S and must apply an Adjustment of status and need to obtain Form I-824 and pay for the fee so we could move on to the NVC stage. --- THIS IS NOT RIGHT. THE BENEFICIARY (Me) IS NOT YET IN THE U.S RIGHT NOW. WE FILED AND WAS APPROVED WITH A SPOUSAL VISA PETITION SO I COULD LEGALLY ENTER THE U.S SO THAT MEANS I AM NOT IN THE U.S YET. OUR CASE SHOULD HAVE BEEN FORWARDED AUTOMATICALLY TO NVC FOR FURTHER VISA PROCESSING.
3. My husband called USCIS and NVC to ask for an update. At first he was told to wait. The next time he called he was told our case has already been reviewed and already forwarded to NVC. But when he called NVC, they said our case is not there yet.
4. Our lawyer received a letter stating that our case was sent back TSC to be reviewed. Our lawyer said we will surely hear a response within 120 days. -- MY HUSBAND AND I WOULD LIKE TO INSIST THAT IT IS UNFAIR FOR US TO WAIT FOR (POTENTIALLY) SUCH A LONG TIME JUST BECAUSE USCIS MADE A MISTAKE IN SENDING THE WRONG NOTICE OF ACTION.
5. Our case should have been in NVC by now for further processing. We SHOULD NOT file for Adjustment of Status/Form I-824 for them to forward our case in NVC because I AM NOT (the beneficiary) IS NOT YET RESIDING AND HAVE NEVER BEEN IN THE U.S YET.

Was he able to talk to a supervisor at uscis? If it was uscis' fault, you should demand for an expedite..

12.12.2013 - I-130 approved, NOA2 via email (never transferred); shipped to NVC

01.06.2014 - requested expedite due to typhoon and PCS

01.08.2014 - Case # and IIN; submitted DS-261; NVC asked for 2 contact #s of beneficiary

01.09.2014 - AOS fee billed

01.14.2014 - AOS fee showed paid

01.15.2014 - IV fee billed; expedite approved

01.18.2014 - sent AOS package

01.22.2014 - IV fee showed paid; AOS arrived at NVC as per UPS (10:18am by FNU)

01.24.2014 - sent IV package

01.27.2014 - submitted DS-260; IV docs delivered to NVC as per DHL (10:52am by PETERS G)

01.29.2014 - CASE COMPLETE (via phonecall)

01.30.2014 - received checklist for Dutch Police Record (VOG) via email

01.31.2014 - left NVC, sent to embassy

02.04.2014 - received at embassy, READY as per CEAC

02.10-11.2014 - medical done, passed!

02.24.2014 - interview: APPROVED!!

02.27.2014 - Received SMS from 2Go, ready for pick up

02.28.2014 - visa on hand; CFO sticker

03.01.2014 - paid ELIS

03.06.2014 - POE Hawaii...Aloooohaaa! :)

04.10.2014 - 2yr green card received

Hello krispykreme!

He was able to talk to an officer that time but Im not sure if that was a supervisor? Because the operator who first answered his call told him to wait because he will forward the call to an officer. Then that officer told him our case has already been reviewed and forwarded to NVC (which wasn't true like I said above). The officer in fact admitted that it was a USCIS mistake and that we should hear something within 14 business days (my husband called 2nd week of December). But until today we haven't received any news yet and everytime we call they will tell us to wait.

It's so sad that we have to wait due to other people's mistake :'(

Im so sorry this happened to you :/ wish i could help but i/we dont have any experience sending a letter or email to the ombudsman.. But u should try and ask help from them, and keep calling uscis and talk to an officer or supervisor. Follow up ur case and ask them if they can expedite it since it's already passed 14 business day and it was clearly their fault. I hope they will be able to fix it soon.

I've read post from other sites that says they actually reply the day after you sent them an email. But if they don't we can wait for about 10 days because they might be reviewing your case and already sorting it out.

I'm looking forward for a postive feedback from them.

They actually replied to my email and that's what they said. It says it might take up to 3 weeks before they enter our case to their system and take action to it.

Yes, that's what they do. They email you saying they got it, then it takes about a month for them to actually process the request.
