Timeline

Sending this after Jan 18, about ten days after the 90 day window commences;

- affidavits from parents stating we live with them

- joint bank account(s), showing he's been paying my medical bills

- joint lease of our time in Arlington, VA

- pictures of us

- pictures of when his father came over to visit

- thinking of getting affidavits from friends saying they know us

- documents showing we went on a vacation together

- taxes filed jointly

Kind of stuck on what else to add?

How about junk mail in either / both your names that are sent to the same address? Magazines even.

We do have all of our mail (important and non-important) and other docs (driver's licenses), showing the same address... that counts?

BONAFIDE EVIDENCE Example list for ROC



1. Evidence of Joint Ownership of Assets and Shared Financial Responsibility


  • Joint Federal / State Tax transcripts for 2 years
  • Joint bank account statements, spanning over 2 years
  • Proof of joint credit card use, spanning over 2 years
  • Mortgage loan contract or lease contract with both partners’ names in it
  • Power of Attorney
  • Wills
  • Utility / Cable TV / Cell phone / Pets visit / Membership / Joint purchase bills
  • Life insurance policy showing spouse as beneficiary
  • Health insurance / Dental / Medical Bills
  • Car insurance
  • 401(K) account information showing spouse as beneficiary

2. Photographic Evidence


  • Photos of you two together
  • Photos of you two with family (such as wedding, parties, kids’ graduation, etc.)
  • Photos of you two in various locations and times

3. Other Evidence in Support of Bona Fide Marriage


  • Birth certificates of any children born to you together
  • Sworn affidavits of friends and/or family
  • Letters/cards from friends and/or family
  • Vacation / honeymoon photos / Boarding Passes showing both of you travelling together
  • Hotel receipts with both your names
  • Other Misc receipts with both partners’ names in shipping/billing address
  • Joint Fishing or Hunting license
  • List spouse as each other emergency contact from employers

If he finally has a stable job and contributing regularly to 401K now, I don't see any harm in throwing that in as part of your bona fide marriage evidence.

Not when you get it before you submit your evidence. As long as you have plenty of other evidences spanning your entire marriage (and conditional GC period) it doesn't matter when you start what. However, it's another thing when you submit evidences that were started/established a few months before your ROC - that will look fishy.

Wouldn't running out and getting life insurance or a 401(K) now (he finally is making a stable income) look bad?

12/11/13 - Response to service request rec'd - vague info about processing times

12/12/13 - Service request via Tier 2 submitted

12/10/13 - APPROVED!!! (letter rec'd 12/14/13)

12/16/13 - 2nd Service request response rec'd

12/17/13 - Card production email/text rec'd (online case updated)!

12/24/13 - Notification rec'd via email regarding card mailed on 12/23/13 (online case updated as well)

12/26/13 - 10-yr card rec'd!

One thing I have learned on this journey:

There is no such thing as an "overkill" evidence package. Submit anything and everything you can. Who knows what will prevent you from getting an RFE.

We have:

sworn affidavits

bank statements (4 scattered throughout the past 2 years)

pictures of us together, him with my kids, all of us on vacation and at various functions throughout the past 2 years

cards

screen shots of Facebook on our anniversary with posts and stuff from people

Colin listed as my beneficiary on my work disability insurance

copy of a bill from the veterinarian with both our names (2 from several months apart)

Health insurance statement with both our names - this years and last years

car insurance cards and statements

We don't file joint taxes because I own a business and do my business tax separately

We don't have a lease or mortgage because we live in my parents second home

Utilities are in my name because I set them up before he even moved here

Hopefully it will be enough. Worst case scenario, we have to go to court. When they see an emotional sobbing mess of a woman terrified to lose her husband, they will see that we are really married.

I keep saying that they just need to come over for dinner one night - there would be no doubt in their minds then

Include more statements throughout the 2 years. Why give them reason to delay/deny your application due to little evidence?

No taxes. Explain in a cover letter.

No mortgage. Ditto.

No joint credit cards. You know the drill.

You have just a bit to show the co-mingling of funds and some superficial evidence. Beef it up and you should be fine. :) Good luck!

Thank you very much! I totally forgot about the cell phone bill too!

I really appreciate your help. I loaded about 11 bank statements, a few more vet bills, cell phone bills, car insurance bills, etc.

I'm also going to get a copy of my emergency form from work.

It's been a couple of years since I've been here, I forgot how helpful everyone is.

utility bills in both names. since you live with parents, this might be:

1. satellite tv bill or

2. cellular phone bill or

3. cable tv phone bill

got em? show 24 months.
