Benefit on Applying I-485 before I-130 has been approved

Hi All,

I am new to the forum and I am currently applying I-130 for my wife. I had read some of the posts and some senior member's application timeline and I have two questions wondering if you guys can help me out:

1. I saw some of you applied for I-485 even before the I-130 got approved. What's the benefit of that?

2. Isn't it the approval to I-130 application will automatically grant you visa entry to the States (IR-1/CR-1)? or we need I-485 in order to enter to the US?

I tried the search function but yet I am still very confuse lol.

I-130 approval does not guarantee a Visa. Approval of i-130 means you are approved for further processing of your visa application. I am not sure about the i-485....

An I-485 is for people are who are seeking adjustment of status within the US, not people seeking an immigrant visa.

hi

you are confused. the i485 is for people who are filing and living in the US. your wife will go through consular processing and the i130 Is only the first form. there are several more and more documents

the i130 will be sent to the NVC or National visa center where the second part of the process will continue until the case is sent to the Consulate or Embassy in her country, where she will have her interview and come with the visa if approved

First of all, an I-130 is not an application form, it is a petition form; an I-485 is not something that is applied for.

The I-485 form is filled out to start the Adjustment of Status process; this is a process that does not apply to you. The I-485 is a form you will never use.

Approval of an I-130 petition will not automatically grant a visa.

August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
