Can you please confirm to me that is it not possible to have a K-1 Visa if you are already married in a country other than the US ?

Seriously? Married is married - that itself disqualifies you from filing K-1 visa.

Hello people . I wanna answer the "phillipine" guy , no sir the process doesn't take 10-14 months , it normally takes 5 to 8 maximum and if the "USCIS" want more time . IT WILL BE FOR MORE REASONS -------> For exemple maybe they need more evidence of relationship or smth

+ Phillipine is not morocco sir . Philippine is one of the countries that the USA doubt about "terrorism"

The Corpease approved that morocco and jordan are the most safe countries in the arabian worlds . So Only the criminal history who judge the person . I Read about everything and i know exactly that the "USCIS" only make sure that the people coming not gonna make any problemes . as well i know that there is diffently problems in the relationship as long it took so long . "wife" been married , "wife" has criminal record . "Husband" has criminal record or been married before or has childreen ......

In normal cases that the US citizen never been married and the foreing too . And they do a wedding and have letters and have pictues of servel trips it means that the relationship is strong

That's what i think . They are not stupid over there . If there is more evidences and they don't doubt they will process it quicly

Yes, there are extra REASONS why we are all still waiting, and it has nothing to do with our actual cases. My case hasn't even been looked at except for when they transferred it. Been waiting for over 9 months here.

I sent in plenty of proof of my 10 year relationship, and close to 8 years of marriage to my husband. I lived with him over there for the majority of our relationship, so there was a lot of it. My husband is Dutch, so not a high fraud country. We have two kids together. We got married in the US, and I also provided close to 20 affidavits from friends and family stating that they knew we were married, were at the wedding, etc. (Every one of them was notarized as well.) Photos over the years, and documents up the wazoo. I have an extremely straight-forward case. And I am *STILL* waiting.

Unless they are very, very lucky, they are going to have to wait a long time too. There are close to 500,000 in line ahead of them. The USCIS has stated that they're trying to clear this backlog, but I think it got bigger than they expected, and they're going to have a very hard time fixing the problems that they created.

Because why u didn't apply 8 years ago . That's so weird why would u wait 8 years to submit ur application while u could have submited ur visa a long time ago and u will be now with ur husband ???

Do u bother them by calling every time or not ?

This is just YOUR opinion..,.,.,you can be married in your hearts, and in God's eyes without a ceremony.,.,.,.,.,WHY NOT take the K-1, with some being done in 4 months in CSC.,.,.,

If that is what they want so be it, but to me it is better to have my wife right here beside me as she is now, in 1/2 the time.,.,.

I agree with Ismeal and you.

We went the CR-1 route for several reasons.

1st reason is because it is my wife that is basically giving up her life in Brazil and to move to a foreign country and we really wanted a wedding in Brazil mainly so her huge Family can see her get married (first born and one of the rare girl born in the Family of mostly men) and also the wedding is a way to say "good bye" to some people that she said she probably will never see again.

2nd reason- CR-1 is cheaper and paperwork-wise is able the same time frame as K1.... we are cheap and hate paperwork and like to do as little as possible.

3rd reason- My wife worked her whole life and want to work as soon as she get into USA. Remember we hate paperwork even if it one paper and 2 minutes of paperwork.

4th reason- We love traveling and most of that traveling is outside of the country even if that is Canada and also her grandparents are in their 90's... we want to be able to get to them within 24 hrs if they turned for the worst. We like the ease of coming and going anytime we want.

Ismeal have their reasons and you have your reasons and please respect everybody's choice and I think most of us have done enough research to find the best path to go forward to. Of course we all rather be able to bring out husband or wife home now but can't. As Ismeal was saying... this whole immigrantion process is a small bit of our whole life. It was Worth it more for Ismeal and me to go CR-1 and it was more Worth it for you to go K1 and that is fine.

No, we don't have a criminal background or any reason for being delayed other than the fact that they stopped adjudication on CR/IR visas for 6 or 7 months (except expedites) so they could process the DACA applications.

Why didn't I apply 8 years ago? Because I was living in my husband's country, and planned on continuing to live there at that point. Why would I need a visa for my husband when we weren't planning on living in the US?

And yes, I've been calling them constantly. No dice.

So after joining yesterday, we have an EXPERT... So no need for our extensive knowledge and experience answering questions... Casa embassy is a difficult embassy... Be prepared. Te wait time has nothing to do with criminal backgrounds, never been married etc... The wait time is your file sitting in a box until someone gets to it to physically look at it and see that you meet all the criteria (4-8 months)! Then, it gets mailed to the embassy (which can take 2-8 weeks),mthe embassy gets it and you get scheduled for an interview (2-10 weeks)... So it does not matter what your "friend" case happened, be prepared with your patience if things don't "happen" like they did for your "friend" maybe you get lucky... Maybe not... But having an attitude that you know better because of one "friends" experience is not a way to get help on this forum. There are 500 "friends" here on VJ that have filed for CR1 visas this year that can tell you a different experience.

No, I was talking to Christeen. When I get my approval, then it's another 4-6 months before my husband gets his visa. Even now, that puts me at over a year before I get to see my husband again. I don't get to relax after this is done, I've got a lot more work to do.

Hello everyone i'm a young moroccan man , 21 years old married to USA citizen 29 years old, married on 15;november2013

I know my wife for 1 year and 2 months . She visit me after 6 months from knowing her , stayed with me 2 weeks in morocco . We waited another 6 months to know each more , Then we knew we gonna married . She get one month off her work . And we get married and visit certain cities ....

The important is that we put a organized file . meaning that we have letter from her parents my parents her freinds and pictures of wedding, and certain places we visit ticket of train , flight ticket .....

We submited our visa on the 19decembre;2013 . We get text in my wife's phone that they get the file on the 22 december and they take the money out from her account .

I read certains topics but i'm really wondering how long the process take . Specially were about to apply for a "K3" after we get the form from cr1

For people who get in this . How long it took u guys to get approved neither cr1 or K3

The whole process has no definite timeframe. Some get approved faster, some later. All you can do is wait and start preparing for the next steps by reading ahead during your waiting time. There is no reason for you to snap at the forum members who are trying to rid your misunderstanding that just because your friend was approved in such and such time, you will have the same. It doesn't work that way. You asked a question, you were given answers. You may not like the answer, but what the members here are telling is realistic and accurate.

Relax, have patience, and get informed by reading as much as you can about the whole process.

It's not just the petition approval that matters. Lots of people have been approved by the USCIS, but denied the visa at the embassy interview. Every step of the process is important, and every visa journey is unique. Also, you just applied last month. Be patient.

Oops, yes I did forget NVC... And to the OP, the first approval is just the first step, NOT the vital one, that just determins you are eligible to petition for your spouse, the Embassy is the one you have to convince that the relationship is bonified...
