We got our first RFE today stating that our "I-129F Petition is incomplete, please submit the following:"

"INTENT TO MARRY: The beneficiary must each provide an original statement (signed and dated) indicating that they plan to marry each other within 90 days of the beneficiary's admission to the U.S. and are both free to marry. Make sure you write your name, sign and date at the bottom of the statement/letter."

We certainly did submit an intent to marry, each. Both were written using the samples provided here. I signed and posted mine to my fiance from New Zealand where I was at the time to ensure he sent the original.

The only thing I can think - is that our letters were dated at the top of the letter rather than the bottom.

Anyone have any other ideas??

"MARRIAGE TERMINATION. "The Judgement/Order summaries submitted as evidence of marriage termination between [my fiance & his ex-wife] is not sufficient evidence. Submit a legible copy of the full final divorce decree that shows proof of filing, or the death certificate, signed, dated and issued by a judge or civil authorities that terminated the prior marriage(s) between....."

We submitted a copy of the ENTIRE five page Divorce Decree document, as signed by the judge and stamped with the date of filing. Although the first page has a main heading "Judgement/Order summaries" - it is definitely entitled "DIVORCE DECREE" on every page and is signed and dated by the Judge. There is no other divorce decree document as far as we're aware.. The filing date stamp on the copy is a little faded - but certainly everything is legible..

Any ideas?.... We're thinking perhaps we need to go back to the court and get another notorised copy from the original filed...

OR - Is it possible that USCIS have lost some pages of documuents we submitted? Any similar experiences?

19th March 2008: Met online

Conversation rapidly developed and flowed via email, IM and thank goodness for Skype!!

Daily contact and three years of visits back and forth between the UK and USA.

Engaged late 2008

9th December 2010: Filed K1 Visa

15th December 2010: NOA1

18th February 2011: "Touched"

18th April 2011: RFE :-/

11th May 2011: RFE reply - after infopass visit discovered there was nothing missing from original filing??.... Resent same information with cover letter.

16th May 2011: NOA2 !!!!!!

25th May 2011: NVC Received

27th May 2011: Posted to London Consulate

Maybe re write your intentions differently. Maybe theyre being particular and always see the same letters of intent bcos people use the templates from websites.

What does that mean you "posted" yours? As in, "posted it somewhere online?"

I can see that your I-129F was mailed on Dec 9, 2010. What was the date that you put on the Intent to Marry? They will be able to see when the last time your fiance went to New Zealand, by looking at his passport stamps (assuming he provided them). Since they want originals and they can see that he didn't go get an original from you, it would to have been dated probably at least 3-4 business days previous to Dec 9. I'd say it would need to be dated December 3, 2010 or earlier to have any shot of having the time to mail it from New Zealand to the US and then him put it in the mail. If it is dated after Dec 9, 2010 perhaps that is the reason for RFE. You said you "posted" it. I don't think you can just post it on a website or whatever that means. You need to actually mail a letter with the original signature. Perhaps they figured out that the signature wasn't original?

I checked our case status and saw we got an RFE today. Can't imagine what it would be except maybe questions about my citizenship (born in one country, immigrated to Canada, got citizenship in Canada). Hopefully it is something easy and we can get the evidence back to them so they can approve us and we can finally move on with our lives. But we should get the hardcopy in a few days and depending on what it is, I may be bugging you guys for help!

Apparently, We got RFE for same. Our case was initially approved by USCIS and sent to NVC. It was NVC that returned case and gave us hiccups as what could be the reason for recall.

Day before yesterday I received RFE in mail with reason and mailed them back with answer, ofcourse, "NO", yesterday. Hope all goes smooth and fast now!
