Let K1 visa expire?

Hi guys,

I'm in a tricky situation right now. I am currently studying for my Master's degree and had applied for the K-1 visa 3 months ago and to my fiance's and my surprise our visa processing has been progressing at a very rapid rate. My case is now with the embassy and will have my interview soon.

Now I know that if granted a visa I'll have to move to the US in less than 6 months.But doing this means I won't be able to finish my studies. Do you think I'll be able to extend/re-issue the visa based on this reason? If not, if I let the visa expire and then once I finish my degree I get married and apply for a spouse visa, will this cause any troubles (in the sense that I let my K-1 visa expire and based on this will I have any problems with the spouse visa?)

No, embassy won't extended the visa expiration. You have to start over again.

Since you already this far, it would be such a pity to let it go. You mentioned in an earlier thread that you have 8 months of study remaining. I *think* (and someone please correct me if I'm wrong) that you can contact the embassy to delay your interview till you are close to being ready to leave, so long as it is before your petition expires (count the expiration date as 1 year from the notice date on your NOA2 - not what is written on your NOA2 hardcopy).

8 months out of 12 leaves 4 months to get a new medical (old one would expire after 6 months) and schedule an interview. A little bit tight, but it should be doable?

No need to let it expire. Once issued, email the Embassy and ask them to extend it. Most will do it for good reason, yours is one.

From my understanding, the 6 months you have to enter the country stated on your visa is 6 months from the date of your medical exam. I've now just read your other posts and seen that you have already had the medical etc, so you are very much bound by the 6 months.

As far as I'm aware, you can't get extensions for the visa and even if you could, I doubt your studies would fall under a circumstance that would allow them to do it as it shows (to them) poor planning on your part - regardless of how much quicker it has taken than you expected. You can try, but I wouldn't expect them to grant it for you.

I guess your option, other than letting the whole thing expire (which is a shame as that's a lot of money out of pocket) would be to call the embassy and see if you can postpone the interview and then have another medical later down the line - this could potentially prevent you from starting the entire thing from scratch and instead just starting from the medical part again. Not to mention if you were to start the whole thing over again, who says it would be as speedy the next time around!!

Reschedule your visa interview to as late a date as possible (you can reschedule twice without penalty), the petition validity will be extended up to a year by the embassy. Don't take your medical until closer to the interview date also, as the visa validity will be tied to the medical date.

Reschedule your visa interview to as late a date as possible (you can reschedule twice without penalty), the petition validity will be extended up to a year by the embassy. Don't take your medical until closer to the interview date also, as the visa validity will be tied to the medical date.

The only issue is that I've already done my medical (I wasn't aware of the fact that visa validity is calculated based on the date of medical exam). Do you think if I do another medical later on it would resolve the issue? (I've emailed the embassy regarding my situation but I'm still waiting for an answer from them)

which country for the interview ?

if you time this 'right', you can have an interview 3 or 4 months after the IV Unit actually has the casefile,

then with a recent medical interview, you have apprx 6 months after visa issuance to immigrate into the USA.

So, that's 9 to 10 months, more, without starting over.

Does that buy you the time you need?

Ah, that may add a kink, hopefully the embassy will give you a positive answer about completing a second medical later, that would for sure remedy your issue.

I'm gonna send an email to the embassy explaining my situation. I'll also mention that I am ready to undergo another medical exam if needed.

There is alot of good information here but to finalize your request. Your Answer is the best. So do it.
