Please Helpgetting married and filing for the I-130

Hello Everyone,

I have a friend from Hungary; he is an international student, actually just graduated. He wants to marry his girlfriend however does not know how to go through with the process or what he is allowed to do while living currently in USA, and neither do I.

My questions are:

Can he get married here in the USA? I am asking this due to the fact that he is an international student who actually finished school. He is looking for a job right now.

If can get married, can he apply for the I-130 here in the USA without being sent back to Hungary.

Please advice me in anything you can. He is my best friend and I myself am going through a lot with immigration from Albania and I don't want another couple that I care about to go through the same thing. :help:

Getting married in the US and applying for adjustment of status are two different things. There is nothing stopping your friend getting married here, his immigration status is irrevelant for the actual ceremony.

It is relevant, however, for adjustment of status. You say your friend has graduated -- is his F1 student visa still valid, or is he still legally here on optional practical training? If he is (which presumably he is if looking for work), then he should be able to apply for adjustment of status. If he is not, there are ways to go through the process while he is still here, though I don't know all the details -- perhaps someone else can fill you in if this is your friend's situation.

I was initially in the US on an F1 student visa, and the overseas students office were very helpful with advice about this sort of thing. Perhaps this is somewhere your friend should also go to get some advice on how to proceed.

30 June 2006 - received packet 3 from Sydney Consulate to do DCF

July 2006 - discover Sydney are changing their DCF process

8 September 2006 - have fingerprints taken, post police check form to AFP

12 September 2006 - medical

21 September 2006 - receive police check from AFP

23 September 2006 - wedding day!

12 October 2006 - hubby files I-130 in Sydney during Thursday walk-in (and I-864). I file DS-230 parts 1 and 2, and DS-2001.

31 October 2006 - interview date... and I'm approved!

1 November 2006 - pick-up visa from Sydney Consulate

14 November 2006 - arrive in the US!

22 November 2006 - greencard arrives in mail

24 November 2006 - social security card and welcome letter arrive

The first thing I'd ask him since he is an international student is what kind of student visa he entered with. If it was an F-1 visa.....he should be fine. He can get married and most likely adjust status without any problems. (Sounds like he was in the USA for a while....which is good....and the plans for marriage and AOS are not something that happened right after he entered).

If he came to the USA on a j-1 visa, then things will be more complicated.

So, first find out what visa he entered with....and go from there.

March 7, 2005 Wife left for Istanbul to serve J-1 2 year HRR. Was a very bad day at Black Rock.

May 23, 2006 USCIS receives application for I-130

June 12, 2006 Noa1

Sept 7, 2006 Noa2 I-130 approved

Oct 10 ,2006 Received fee bill from NVC

Nov 13 ,2006 Received Packet 2 DS-230

Jan 4, 2007 Mailed Packet 2 to NVC

Jan 22, 2007 RFE from NVC aaarrrrgggghhh!!!!!!!!

Feb 28, 2007 NVC received "checklist" response and original documents for the RFE

March 13, 2007 Case completed at NVC! Whoooohoooo!! Ankara, here we come!!!!

March 15, 2007 Case fowarded to Ankara Embassy

April 4, 2007 Interview. Wife gets handed the little green paper. Not good. Need to submit a few more things.

April 9, 2007 Items mailed back to Embassy. Crossing fingers, rubbing the "rabbit's foot", etc,..that this may FINALLY be the end.

April 14, 2007 Visa delivered! Wife is finally going to be on her way back home!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

April 20, 2007 Wife enters through JFK. The days of grabbing my dinners at the WalMart deli....are now officially over!!!
