2 last names calls 4 some confusion

Timeline

in most if not all latin american countries children use BOTH mother and father's last names. now my fiance's father never signed his birth certificate so technically his "cedula" (it's like our SSN card) should've just had his mother's last name. BUT he (or someone!) put his mom and dad's last names when filling out the form so his cedula appears like his first name, his dad's last name then his mom's last name. when he went to get his passport they put his name down word for word from his cedula's info (we requested just the mom's name but they say it has to be like it appears on the cedula). so his passport, again, says both names. however, my fiance only wants to use his mother's last name as his official name (dad never really in the picture) and that's the last name he's always gone by anways (unofficially). my question is on the I-129f and G-325A and any other forms that ask for his last name...well what should i put? can i just do his mom's last name (ideally) or would that be wrong since all his documents list both parent's? i mean in the US the last name is the last name which is technically his mother's name or am i splitting hairs? would a legal name change when he gets to the US be the only way to drop the dad's last name? sorry this is so long...

May 2nd - Sent I-129F to Vermont

May 13th - NOA1

June 23rd - recieved RFE (IMBRA)

June 24th - Sent back RFE

June 27th - 7 touches

June 30th - touched

July 3rd - touched

July 10th - NOA2 notice via email

July 14th - NOA2 via snail mail

July 14th - petition mailed thru DHL to Asuncion, PY

Week of July 17th - Embassy received my petition

July 24th - beneficiary receives packet 3

July 27th - medical exam

Aug 7th - interview - approved :)

Aug 11th - picked up his visa

Aug 21st - purchased plane ticket!

Aug 30th - reunion day :)

You're dealing with the US government. Do everything how you would in the US. Use his mom's last name. His dad's name is his middle name, not his last name. A person can only have one legal last name at anytime, regardless of which "unofficial" ones he'd used.

Names on visa petitions and applications must match birth certificate and passport names.

You're dealing with the US government. Do everything how you would in the US. Use his mom's last name. His dad's name is his middle name, not his last name. A person can only have one legal last name at anytime, regardless of which "unofficial" ones he'd used. Names on visa petitions and applications must match birth certificate and passport names.

Right I agree BUT his cedula is like this: (just an example!)

last name: Smith Johnson

first name: Mike Sam

I'd understand it if his name wasn't classified like that and instead just written out Mike Sam Smith Johnson. what do you think?

You're dealing with the US government. Do everything how you would in the US. Use his mom's last name. His dad's name is his middle name, not his last name. A person can only have one legal last name at anytime, regardless of which "unofficial" ones he'd used. Names on visa petitions and applications must match birth certificate and passport names.

Right I agree BUT his cedula is like this: (just an example!)

last name: Smith Johnson

first name: Mike Sam

I'd understand it if his name wasn't classified like that and instead just written out Mike Sam Smith Johnson. what do you think?

So what's the problem?

Johnson is the last name.

Mike is the first name.

Sam Smith are middle names.

My fiancee had 2 last names as well. We put her name down in the form as it would appear here....with her father's last name.

Then, we filled out the line for other names used and put her full name (with her 2 last names). I also put an explanation in the cover letter. The USCIS deals with Latin names quite frequently, and I did not have an issue.

12/5/05 Sent I129F Petition to Nebraska via Express Mail

12/6/05 Packaged received at 10:38 am in Nebraska

12/9/05 Check cashed (Never been so happy to have money leave my account)

12/12/05 Receive NOA1 snail mail - 30-60 day processing estimate

01/04/06 Receive NOA2 via e-mail

1/20/06 NVC letter in mail...will ship within a week.

2/1/06 Packet 3 and 4 in the mail

3/15/06 Interview - neither approved nor declined need to send in Migratory Movement Certificate AP

3/20/06 Migratory Movement Certificate for myself and fiancee sent to US Embassy in Lima

3/23/06 Visa Approved

5/19/06 I leave for Peru to pick up mi amor

5/25/06 Lucia and I arrive in Chicago

7/01/06 Legal Marriage

9/09/06 Religious Wedding

I'm from Brazil and My name is Marcela Martins Espindula.

So Marcela is the first, Martins(which is my mom's last maiden name) the middle and Espindula(my dad's last name) the last.

Latest steps:

10/26/2006- Consulate receives case (seriously, one month to receive the case?? BS!), and packet 3 that I sent even before they had received the case.

01/02/2007- Interview!!!!!!!!!!!!! Got a 221(g)

01/23/2007- Second Interview. VISA granted!!!

01/29/2007- VISA arrived.... no envelope though. I'm gonna contact them and see what happened this time!

01/31/2007- I'll have to send them one last financial support evidence.

02/01/2007- Evidence sent

02/02/2007- Evidence received by Consulate

02/06/2007- Consulate sends envelope!

02/07/2007- Envelope received!!!

02/10/2007- Flew to the USA!!!!!!

04/17/2007- Wedding day!!!
