Hi I am new to the site and hopefully I will be able to provide some information and receive some helpful advice. A bit about our situation...

Ok so my fiancé came here on a B1-B2 visa we married November 18th 2013, We told the Consular that my intentions was to marry, but she was going back to Cambodia, so we kept our word to him, and now I want to apply for her visa's for her and my 2 step children here, I hope I can I get some advice, it says that each person needs the visa but I thought they can travel on her spouse visa, since they are dependents? Any assistance would be greatly appreciated, I have listed her as emergency contact, beneficiary, also have purchased family Health Insurance plan for her and the children, we have lots of photos documenting our wedding, we stayed together as husband and wife in Chicago for 3 weeks in a hotel, because I relocated to Chicago for work. Can this be expedited? What are the forms I need to file. ( have done research on the process but just wanting confirmation, because don't want delays, and I know it can be confusing.

Thanks in advance,

Corey

You apply separately for your spouse and her kids.

Her visa is for her. There is no such thing in the US such as a single visa that covers multiple people. One visa; one person.

Read this. Same situation as yours. http://www.visajourn...n/?fromsearch=1

What would be your basis for an expedite? There is line. What is the extraordinary reason that your family should skip in line in front of other families?

Read the Guides. There's one for petitioning a spouse. There's another one for petitioning stepchildren.

If the children were below 18 years old when you married, yes, you can file i-130 for them as their step-dad.

Your wife and step-kids will immigrate in more or less a year.

So I am seeing posts that you file form I-130, or the CR1....We are married which is the proper form, both children are under 18...This site is sort of hard to navigate.sad.png

You are a US citizen, right? If yes, then you are in the correct forum.

Yes I am a USC, which forms do I fill out. Is it the CR1 and I-130?

You fill out i-130 for wife, i-130 for child #1 and i-130 for child #2. Separate cheques of $420 each.

MUST READ i-130 instructions: http://www.uscis.gov/sites/default/files/files/form/i-130instr.pdf

i-130= Petition by USC to bring relatives determines your eligibility.

©IR-1 visa+ actual name of the visa your immediate relatives would get.

File i-130 to USCIS. They approve it and the goes to National Visa Center (NVC) during which your IR fills DS-260 (actual visa application) and from there to consulate and interview. This is only a overview. Now you can read the guides and it would make sense,

As I understand it she will need a GC to sign up for ACA.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”
