Hello everyone,

I filled I-130 for my wife and has priority date SEP 26, 2013.

My category F2A and my wife is not in USA. she is in my Country " EGYPT"

I received NOA1 on 10-1-2013

I received NOA2 on 11-1-2013

I emailed NVC on 12-1-2013, they responded the email with NVC case number on 12-4-2013 but it says also the following text

"Unfortunately, visa numbers are not presently available for your use. You will be notified when further consideration can be given to processing your application for immigration. The reason for this delay is that there are more applicants for visas than there are immigrant visa numbers available under the limitation prescribed by law"
So, My Questions:
1. Does it mean that NVC will not send anything to me until my priority date to be current or what?
2. What should I do next or What is Next?
Just need a clarification for what will be done

Timeline

They will still process your case, however, they will not schedule your wife for an embassy interview until her PD becomes current in the visa bulletin.

It may take 8 weeks for NVC to generate a case number for you.

I actually got the Case Number from NVC today

I'm asking Is NVC will not do anything until my PD be current or will ask me to continue process then I'll wait for PD

NOTE: I just filed I-130 only and didn't do anything yet

Did it include an Invoice Identification Number (IIN)? If yes, you can check if the DS261 is already available for you: https://ceac.state.gov/ceac/

Yes, they will still continue the process even if PD is not current.

Yes, they will still process even if PD is not current.

I paid only the filing fee $420 that's it.

NVC sent email today with pdf with the following:

Hmmmm. So there's no IIN. I guess I'm wrong blush.png . You won't be able to access the CEAC without the case# and IIN.

I can't answer when the PD will start moving again in the visa bulletin. Sorry. unsure.png

cut off date for F2A Sep 2013. And you are in line in Nov 2013. Right now you can get only Case no from NVC. And have to wait . Check the visa bulletin .

It depends. Another member shadowflex(Wish i could tag that person here) PD is Sep 10th 2013. Cut off as per December Bulletin is Sep 8th, 2013. That person did get AOS invoice and IV invoice even though PD is not current for them. How? That is because NVC can do that if they think PD will be current soon and DOS would have given them the cut off dates for the next month or two much earlier before they publish to the general public. So if DOS thinks F2A will not move to Sep 26th, 2013 in the VB in the next few months, NVC will not process if the qualifying date is not Sep 26th or earlier.

I posted in another thread where NVC starts processing the case when cut off date in the VB meets a "qualifying date" (thats what NVC calls it). Qualifying date is beyond the cut off date in VB. How much beyond? I have no idea. So in the case of the member whose PD is Sep 10th,2013 i guess that Qualifies for NVC to process the case which in turn leds me to believe that VB for F2A will move atleast by a week soon(from Sep 8th, 2013 to spe 15th, 2013). :-)

Your guess is as good as mine.

If you get an email with the AOS invoice and IV invoice in the next few days then i believe its safe to assume that NVC will process your case. But since you got an email from NVC already that there are no available visas or your PD does not meet NVC's qualifying date I am not sure how it will work now. But if you do get an invoice to pay AOS and IV bill then NVC is seriously screwed up!

They can't send you an email talking about unavailability of visas and then after 10 days send you another one asking you to pay invoice unless they think VB will change that dramatically soon.

Goodluck anyway and keep checking the CEAC website often.
