Can I ask why they thought you were already married?

it was a long story. when i visited him last fall we tried to get married there. my lawyer friend thought he could get us a waiver of the 30 day waiting period, but in the end he couldn't get one, and i had to get back to work or be fired, so had to come back to the US. i explained this to the nvc and uscis in the cover letter with my i129-f packet, including documentation. they could also see from my passport records and hotel bill and plane tickets that i couldn't have been there 30 days, so they approved the app. only when mumbai saw the same thing they decided that we were married after all, completely wrongly....the same evidence was there for them, but they didn't understand, don't know the 30 day rule. this all surprised me as they should know indian marriage law better than i do but they apparently don't...they had made my fiance take that part of the interview in english instead of the hindi he had requested for the interview, and he tried to explain it all in english... it is hard enough to explain for me in english, lol, and when they insisted that we were married, he tried to explain that we are only married in our hearts but not legally... they just messed up everything, they follow their own wishes instead of the rule of law there... and we are the ones to suffer for it... they made many mistakes since they got the case back in february, and have delayed and delayed us, finally outright denying us... and they have refused to send back the file to uscis or nvc, so that we can appeal it, sending me a snotty email reply to my request, basically saying that they will send it when they want to.... they phrased it differently but that was the upshot of it, they will do it whenever they want to..... they make up their own rules in mumbai..... we just want to get married and live a happy life together but they don't seem to want to let us........ :cry::crying::clock::protest::help::(

Yes, all government offices (including TSC) are closed today...but I'd like to share something.

On May 19th, my 5 months came and went, I spent about 5-6 weeks trying to get my Senator to do something and nothing happened. Two weeks prior to May 19th, I spoke to someone who put in a service request and said I'd have something in writing within 2 weeks. I waited 12 days and called, the man said I had to wait until May 21st. On May 21st, I had a very very important exam to take. I was supposed to take it at 10am and was chastised by the testing moderator at that university. Not even thinking about the petition, I ran home and tried to find another testing center since I only had this one day off and I had been putting this test off for YEARS. Finally I found one and they said I had to leave that minute in time to make it to this 1pm test which only had 1 spot left. Already frantic, I get in my car and start driving to this other city about 20 minutes away to take the exam. All of a sudden, I get a phone call from an out of state number. I answered and when this woman introduced herself I literally had to pull to the side of the road and burst into tears. It was my case officer. She called me to just ask me to fax her something but she was so kind and so sweet. Actually, the last 3 people I've spoken to have been very very nice. I think that's because I empathize with them and don't get angry. Certainly some of them say horrible and heartless things, but they get bombarded with calls (at the cust svc. center) and people yell at them all day. I work for the government and I get those calls too. In fact, it gets to the point where coworkers literally take their phones off the hook and let their voicemail fill up (this irritates me beyond because then I just get the calls.) Anyway, this woman was laughing sweetly at how these tears of joy were just streaming down my eyes. Did we get approved? I have no idea - I had missed 2 questions on my I-129F and she just was asking me to fill it out and fax it to her and she'd make the decision. So why was I crying? I was crying because I was just happy I had someone looking and reviewing my case. Something so simple had tears of joy streaming down my face. Imagine if I had gotten the approval! She even said "calm down sweetie and go pass that exam!" (I told her how incredibly inconvenient emotionally this call was for me lol.) She was talking to me a bit and although my last updated date is January 6th, I'm holding out hope it will change this week.

I guess the point is - I just want to share with everyone that as beyond nail biting, teeth grinding and hair pulling irritating this whole process is, when we call, no matter how mean and nasty they can be at the cust. svc. center, just try to kill them with kindness. I'm almost sure that the last cust. svc. rep somehow helped in some way (the one that told me to wait until May 21.) We connected on a very human level and not an officer - petitioner level.

Lets just keep our hopes up and as many of you had said before..we're all at or approaching 5 months...we've gone up and over the hill and this part of our journey is almost over.

Congrats atleast you have someone working on your case ...You will get an approval soon!!:) Well in 4-5 days it's my 5 month mark.. So i contacted my State Senator..my fiance was scared that it may delay our case somehow. In 2 days our state senator contacted us through email, then they called in to my fiance(Petitioner) and in addition to that, they sent the privacy consent form through mail. Even though we didn't need it because my fiance had printed out the privacy release form over on their website..So i made him fill it out ,so this Sunday my fiance faxed it to their office hoping that they receive it tomorrow since today their office /isclose due to MEMORIAL DAY but i just wish they can do something about our case :( Especially because the situation here in Venezuela is not getting any better! and just watching April and may filers getting approved is making me and alotof you mad :( i will PRAY :)

We hit the 5 month mark on the 24th. I called USCIS today and asked to speak to a tier 2 rep. of course I was told that TSC is behind and that the 5 months is just the normal time given but it could take longer. The rep. stated it could take 6 months or in some cases 8 or 9 months. She told me to call back in 38 days if I haven't heard anything by then. She also said that TSC is working on cases from 11/16/13. I asked her why is it that others are getting their applications approved before the December filers (which is very unfair) and she told me every case is different depending on the background checks, the country filling from, blah, blah, blah. I did ask the rep. if I contacted my congressman would it help the process and the rep. stated no. She said once we contact the congressman office we would not be able to call the USCIS office for status, updates, etc. (don't really believe that). My heart is so heavy right now cause we have waited the 5 months and still being told to wait even more time. When will this all end????

This is incredibly unfair. There has been ZERO change in TSC for months now. This has to stop!

Just look at how much it has declined in approving petitions in the last 6 months!

That is ridiculous. Just curious, but according to the Historical Visa Trends (http://www.visajourney.com/content/k1historical), it shows applications with a NOA1 from April and February receiving NOA2s. Is this an error and if not, why aren't earlier applications being processed first?

I don't trust the data estimates here on VJ because people do not accurately put their data in their timelines or they don't update them!

The historical data is void.

My figures came from the real data on the USCIS.gov website which shows accurate figures direct from the government.
