I'm on disability and haven't filed income tax since 2007. Mr Wahl from fiancée visa services says that I will need to get copies of my 07 06 05 tax returns which were the last years I filed taxes. But when I contacted IRS I was told that to get copies from that long ago could take up to 75 days. Our CR1 is being expedited because of my health so I need to get the financial information quickly. Also I will be using a cosponsor.

So my question is cant USCIS use my SS statements ?

Probably not; you would need the IRS transcripts.

I don't think obtaining tax returns from years ago would be any help. You need to provide a letter explaining why you have not filed any returns for the past few years. The letter needs to state that your income was not above the amount required by the IRS for you to file.

Whoever gave you this advice is wrong. I used social security income for my affidavit of support, I hadn't filed taxes for many years, and was not asked or required to obtain my transcripts from when I filed last I have no,idea who mr wahl is, but he is just wrong.

USCIS will not be making the decision here; the decision will be made by a CO at the Embassy (which is under the purview of the State Department).

Your advisor is wrong it’s your last 3 years you need to show. If you didn’t file you need to write a letter why you were not qualified to file income taxes.

Since you have a co-sponsor and they meet the requirements that should be fine.

I like this answer very much.

However could CO (which stands for Consular Officer) share information with Social Security representative? Since they located in same Embassy SSA administered by Veteran Affairs, would DoS be privilege to get data from them down the hall (e.g. next door) or prior authorization grant CO to access SSA database.

SSA frequent probe IRS filers and raise up red flag for SS recipients who earn too much. In the past they raised hell with my late Dad for overpayment claim and demand for repayment.
