I am a K1 visa applicant from the Philippines. I enjoy this forum a lot and we owe the approval of our petition to eveyone who has been so helpful and accomodating to all guests and members here. I have a concern that your utmost attention and reply is badly needed.

Just last Thursday, we got an early xmas present ---OUR APPOINTMENT FOR MEDICAL AND INTERVIEW - were posted online. We got a February 1, interview schedule. At 1st, we were happy and excited but when we enumerated all papers that ill be needing to present during my interview schedule, we were hoping that the interview was scheduled later than Feb 1. The reason for such was because the W2 form for 2006 will only be available by end week of January. ACoording to my fiance, the government/employer normally releases W2 form around that time. We were waiting for this schedule and we are hoping that you can help us to determine a better solution for our problem. My fiance suggested to just send me his available pay slip for 2006 just to be able to to show them his income and his tax contributions. Do you think this is a good idea or you have other input that would be very helpful on our problem. Thanks in advance.

Hello there. My fiance is also from the Philippine's but is living and will interview in United Arab Emirates. As such, I don't know if Manila askes for tax information for the past three years, or for the past year. UAE only asked for the past year.

Either way first determine if your fiances 2005 income is sufficient to pass the 125% poverty guidelines. If so, then he can simply provide you with 2005 tax information (or 2003, 2004 & 2005 depending on if they ask for 3 years of information.)

IF your problem is his income for 2005 was considerably lower than this year, perhaps even under the 125% but this year is fine, then he could likely scan and email you his 2006 W2 as soon as he gets it. (Perhaps an expert from the site, or veteran of the Manila embassy can tell you if this idea is workable based on the documentation that embassy expects.)

  • February 12, 2007 Abu Dhabi Interview SUCCESS!!! February 14 Visa in hand!
  • March 6, 2007 she is here!
  • MARCH 14, 2007 WE ARE MARRIED!!!
  • May 5, 2007 Sent AOS/EAD packet
  • May 11, 2007 NOA1 AOS/EAD
  • June 7, 2007 Biometrics appointment
  • June 8, 2007 first post biometrics touch, June 11, next touch...
  • August 1, 2007 AOS Interview! APPROVED!! EAD APPROVED TOO...
  • August 6, 2007 EAD card and Welcome Letter received!
  • August 13, 2007 GREEN CARD received!!! 375 days since mailing the I-129F!

    Remove Conditions:

  • May 1, 2009 first day to file
  • May 9, 2009 mailed I-751 to USCIS CS

Thanks ... His 2005 income tax is fine so as his w2. yes, i will also provide the last 3 years of both to the embassy. But his income this year is bigger than 2005 so we wish to provide it also. Is there any way we can do now given the consireation that i wont be able to bring it during my interview? Can we ask an earlier copy of the w2 form ? thanks

He will likely provide you with copies of his current paystubs, and he could still go ahead and scan and email you his 2006 W2 as soon as he gets it. I doubt he can get his W2 early, but if he had sufficient income from his 2005 W2 to beat the 125% poverty guidelines, then his increase in income can also be shown by his latest paystubs anyway.

Sounds to me like you two have nothing to worry about in the income requirement department. :yes:
