Interview is near without NOA2, and unsigned form 1040

Hi everyone, I am new here, and I am very anxious about my upcoming interview on the 19th..

My fiance and I never recevied an NOA2, and i am worried the C.O. might ask for it..

We only received NVC letter stating that our petition has been approved, and our case number, and that we could schedule an appointment for interview and do the medical exam already.

We have been arguing about this for a long time, and he cannot get through USCIS, someone told him that it's okay as long as we have the NVC letter, and another one form USCIS did not entertain him because she said everything was transferred to NVC already.

Another one is his form 1040.. He said it was electronically prepared that's why there's no need for signature.

Does it need to be signed? I already have it with me, and it says SIGN HERE on the back, where he left it blank!

Please help! thank you!!

That's really odd that you don't have the NOA2 and yet you have the NVC letter. It's usually the other way around. Regardless though the CO won't ask for any of the 2 (NVC or NOA2 letter). They will have a copy of it but if you have time you might want to ask USCIS where your letter of approval (NOA2) went.

With the 1040 it's ok if there is no signature since it was filed electronically. I presented a 1040 that was electronically filed also and no problem at all.

You don't need the NOA2. They don't ask for it. The 1040 needs to come with his W-2s or they won't accept it, as anyone can fill out a fake one.

Our interview is on the 19th as well :)

NOA2 is not on the list of documents to bring to interview but we read that it is needed for AOS. Did you just contact USCIS via phone or emailed them too?

While the NOA2 is not needed for the K-1 interview, it IS required and needed for when you file to adjust status after you are married.

Thank you for all the replies.. i've read somewhere that to ask for a copy of NOA2 that will be 405$ which is too much for a pc of paper..

Sounds like a lawyer trying to make money.

hi and thanks for the response! i know right.. it is just too weird.. though maybe the noa2 got lost somewhere because we got approved while he was visiting me here in the Phils., though his siblings would've gotten it just like the notice of transfer and the nvc letter.. hope it won't be a bother, my fiancé just always tells me we would just face the problem when we get there.. so maybe we'll go and request it once we need it for AOS..

maybe we'll see each other at the embassy :)

my appointment is at 7:30am..

we called USCIS via phone.. and one said it's okay not to have it as long as we have the NVC letter..

the other one didn't entertain us and said all our papers were already transferred to NVC so they can't

help us now..

thanks.. i do have his most recent W-2s for 2012 and the form 1040.. Im just worried he left the "SIGN HERE" part blank at his 1040.. though as emmandenn says, it's probably okay.. been bugging him to sign it though just in case..

NOA2 is not asked for during the visa application, so don't worry about it..... now. You will be fine at the interview regarding the NOA2.

As for the tax return, have him sign a copy and EMAIL it to you.

Your fiance (petitioner) does need to get in contact with USCIS and have them mail him the NOA2 (I-797C) as you will need a copy for Adjustment of Status once in the USA.

I am not sure what you mean by this. If you lose the NOA2 I-129F approval notice, you will need to file the I-824 to replace it. The fee is $405. > http://www.uscis.gov/i-824

Wow, then, I agree with the OP, it's excessive for a piece of paper - and a copy at that.

Hi guys!!

Just want to update everyone, we just got our NOA2 today!! Can you believe it?? My fiance has this grin on his face (i-told-you-so-look)

Cause I told him it was impossible that he didn't get it and it could have been lost somewhere bec. we already got the NVC..

Interview finished, Visa approved, and ceac says now it's issued (hope it will be delivered to my house soon) - and then NOA2 arrives..

Talk about snail mail..

Though I am very very thankful we don't have to spend 405$ for it..
