Can NOA2 get approved so fast?

I'd pay triple the fee for the spousal visa if it meant I was actually allowed to be with my wife and child as a family, regardless of whether I would have go through AOS while with them. I could care less about AOS if it means we're together.

So basically you're saying being apart from our spouses for what might be 15 months to 2 years is the equivalent of having to go through the AOS process, and in that way makes up for the fact we don't have to go through it? I really think that's a stretch if it is in fact what you mean. My apologies if I'm wrong.

I'm simply addressing the why the CR1 takes a lot longer than the K-1. It's because the CR1 involves 2 steps while the K-1 involves only the shorter first step.

That's it. I was in no way addressing how anybody should feel about it or how it "makes up" for any emotion during any phase for anybody.

I would rather not get into such a mudslinging comparative argument between those going through both, as I have seen it between many on here, not just between K-1/CR1, but also between different service centers and even between those who went through the same visa type and service centers but at different years.

It happens of course because people get tired of waiting and start bickering out of frustration, especially when they see others getting what they themselves want. Of course, the frustration should be directed at USCIS rather than each other, and we should instead just be happy for each other during each step, but it's not going to happen simply because there are always going to be some people that simply cannot be happy due to what is happening to them.

I am happy for everyone despite what they have filed or how long they have to wait. Positivity brings blessing, negativity can consume you, so i chose to be positive and for that I feel very blessed! smile.png Good luck to everyone!

but I really really feel with CR-1/IR-1 couples it's just NOT fair

altought I feel like a lucky one, my whole process took "only" 3 months (Germany,FRN)

we filed in Germany but our I-130 petition was send to Rome/Italy because they overloaded hire

after my petition was approved(2mons) they guys over hire (Visa Branch) did an amazing job, I already received my Visa so the whole family will travel and stay together.

I was thanking you for your apology, not brushing it off. I never stated any upside or downside to anything. And I never implied anyone was at fault except the USCIS.

All I was stating was the fact of why CR1s are naturally longer than K-1s due to the two step process. That's it.

First of all congrats to all K1 filers that have been approved and regardless of the time frame. For me an approval whether its a K1 or a CR1/IR1 just means there is one less file at USCIS needing to be adjusticated.

I agree with you Leon & Mylen, the CR1/IR1 visa does take longer due to the fact that essentially it includes the AOS step before the issuance of the visa.

There is no debate that the spousal visa typically takes approx 3-4 months longer than a K1 visa. But that is for the whole process, from fiing your petition at USCIS to visa issuance.

USCIS at the moment holds the same national goal for both K1 and CR1/IR1 petitions which is 5 months. They are more than upholding that goal when it comes to K1 filers but with the spousal visas they are very far off it.

If you compare the I-129F form and the I-130 form, the information required is basically the same. The evidence required differs alil, as a marriage certificate is needed for one and a letter of intent for the other.

So i will hazhard a guess here and say when it comes to the USCIS part of the process, there isn't an extra step for the spousal visa over the fiance one.

The CR1/IR1filers' frustration is that there is no balance between the two. A spousal visa filer is aware that the process does take longer because of the type of visa they have petitioned for and I don't think they would mind (myself included) if K1 filers were approved in 2 months and they were approved in 4. But right now, as things are K1 filers are approved in 2 months and less and CR1/IR1 filers have at least an 7 month wait.

I received the NOA2 within 28 days after the NOA1. I was extremely happy that it was moving fast, but now the NVC is taking forever to give us a case number crying.gif My fiance and I are extremely anxious, so I keep calling NVC every single day

There are always going to be fast and slow processes, I think, no matter whether K-1 or CR1 or AOS or ROC or anything! We filed K-1 last year, November 2012, and it took us well over 6 months just to get NOA2, then another 3 months for visa issuance -- total of 9 months from filing to POE. At the same time, there were filers waiting nearly five months MORE than us -- many July 2012 filers for K-1 waited 14 months from filing to POE, on a K-1. I am really sorry that the CR-1's are taking so long right now ... it's not fair and it's frustrating but the whole system is a pendulum and there will never be balance and fairness, I'm afraid.

OP, congratulations, consider yourself VERY lucky to have gotten the NOA2 in record time, and good luck on your upcoming steps!

K1 petition approvals are happening in record time, fastest I've seen in 15 years of monitoring.

I saw an I-129F get approved in two weeks last month. Most others I have submitted recently have been averaging 30-60 days.

Explain what you mean by pendulum, please.

I simply mean that no one can predict which applications will be processed in normal time, and which will take forever. Currently the CR-1s are at the really awful long end of the pendulum, but there are going to be times, past or future, where K-1s will be taking forever, as there have been in the past. I am not trying to place any type of petition over any other, so please don't take any offense. Do whatever you can, organize and write letters and take action as we did when the K1s were taking 9+ months with no movement, when the CSC said petitions were flooded and lost and there were catastrophic delays ... it was not a fun time to be waiting, and I never want to go through it again.

I hope sincerely that processing times will improve for everyone. But knowing USCIS as I do now, I strongly suspect that there will always be times when THEY focus on approving certain types of petitions faster than others, for reasons known only to them. It's not fair and it's stupid, but the system we have is pretty much broken and I don't have much hope of it ever being "fair" to all.

I do sense that you're really really defensive, and I hope I'm reading that wrong. I mean no offense and I wish all filers the best of luck in this horrendously uncertain waiting period. Please don't think anyone wants anything but the best for you.

I do sense that you're really really defensive, and I hope I'm reading that wrong. I mean no offense and I wish all filers the best of luck in this horrendously uncertain waiting period. Please don't think anyone wants anything but the best for you.

No, no defensiveness at all. You're reading it wrong. I just feel that the pendulum is not going to swing the way of the I-130s for a long time. Because if they would have tried to make the situation better and swing the pendulum back the other way, the USCIS would have addressed it a long time ago, and it looks like their current remedy of transferring files isn't really improving the process that much at all. I'm very pessimistic about the whole thing and have planned on a 12-16 month wait until my wife and child are over here.

K1 petition approvals are happening in record time, fastest I've seen in 15 years of monitoring.

I saw an I-129F get approved in two weeks last month. Most others I have submitted recently have been averaging 30-60 days.

I have noticed too that a lot of people recently have gotten NOA2 so fast. Is there any reasoning behind this? I submitted my I-129F 11/19/13 and got NOA1 on 11/25/13. Then 2 days later on 11/27/13 got an update about Alien Registration # being assigned to my Fiancée.

I am hoping that this speedy process continues because if so then we could be in the batch that get approves fast. Of course we were prepared to wait quite a while for the process but would be nice to get the NOA2 in the 42 day average that it is currently at.
