K-1, K-3, evidence for I-129F etc.

Timeline

Me (Hong Kong) and my girlfriend (Natural-born US citizen, Los Angeles region) has been in a close relationship for a few years, and over these years we have visited each other:

  • Early January 2005: she went to see me for 4 days
  • Late June 2005: I went to see her in Los Angeles
  • June 2006: She went again to see me

But since visa wasn't ever in my mine over these year, we weren't at all care about the evidence-getting for I-129F, and when the problem of visas really arose these two months, I got a bit perplexed.

What I have for her first trip to HK are just some digital photos I took in HK, but not together.

What I have for my trip to the US on hand is:

  • Passport stamps
  • Credit Card statement for me paid for a room in the hotel I stayed, plus some US-related spendings
  • Receipt of buying 2 tickets at Universal Studios
  • Incomplete set of airline stubs
  • Photos I took for her (but not together)

As for her second trip to HK, the evidence I have is the same.

As I know her evidence is still a bit megare; even she had a photo we took together at the HK airport.

Other info that is important in the equation:

I am applying for grad school in the US (bioinformatics), and would expect going to the US for interview early next year.

Questions begin:

  • Are there is enough evidence for a K-1 up to this point?
  • If the answer is no for above: I know it's not wise to marry on a B-2 visa; but is it advisible that we marry outside of the US so I can get a K-3?
  • Or, should I wait until I know the admission results (since I would be getting a F-1)?

Thank you for your answer in advance-- and sorry if my language is so disorganized.

(I think my girlfriend would join in the discussion too; it's she who told me about VisaJourney!)

08-19-14: (Day 98) - e-Request initiated for I-131

08-25-14: (Day 104) - EAD file (at least) transferred to MSC (According to InfoPass appointment, 9/5/14)

08-28-14: (Day 107) - Second Service Request initiated

09-05-14: (Day 115) - (1) NCSC reply to second Service Request, identical to one on 7-30 (2) InfoPass appointment on EAD issue. Staff notified my file is now at MSC instead of NSC.

04-03-15: (Day 328) - Email notification of EAD/AP Approval

04-10-15: (Day 335) - EAD/AP Approval letter received

04-13-15: (Day 338) - EAD/AP Card Received

The requirement for the K-1 is rather simple and straight forward. Show evidence you did meet at least once in the last 2 years. Photos are considered secondary evidence, so I would send 1-2 of what you have of her in HK and and you in CA. The strongest evidence you have is the passport stamp and finacial records.

You can then concentrate on gathering the evidence needed for the interview to show this is a valid relationship.

You can expect approval for her petition to have you considered for the fiance visa 3-6 months after you mail everything in. Then you woul dhave to check on the length of time it would take to schedule the interview and process the visa in HK. Most couple can do this process in 6-9 months. I know China can be very slow to schedule interviews, but being in HK, I am not sure this will apply to you?

HK as I know it is laxer terroritory; for some reason we are in negotiation with the US for visa waiver. I was skeptical of the result of course, but it definitively meant HKSAR itself is on good terms with the US immigration-wise.

The main problem, here, is the proof of valid relationship. I have years of ICQ histories with her, sure, but should I print all of them...?
