Hi

My Fiance and I had an email on 30th Oct from USCIS saying our application had been approved, and then two days later he rec'd a letter saying that our application had been forwarded to the Consulate

This has confused me slightly. Are we missing a letter?

Isn't that the letter the NVC are supposed to send? If so, we've not rec'd a hard copy of our NOA2 (I did think this was the hard copy of our NOA2, hence a date on my timeline)

There's nothing about the NVC on the letter, it just says that our case has been forwarded to the listed Consulate and to contact them if we have any queries

Is this normal?

I have seen a couple of other timelines where the NVC dates have been left blank. Is this the reason why?

USCIS will send to the NVC. The letter your fiancé got in the mail should be your NOA2. Give it 2 weeks and start calling the NVC and Department of State about case number. NVC will send to embassy.

It's normal and confusing. I think they mean "we're done with you at USCIS and are sending you on to the consulate part". But it will go to NVC. Then the NVC will notify your fiancé of the new case number and when they send it to London. You aren't required to call NVC. The blank timelines are probably people who didn't call NVC to ask when their case arrived.

You will receive notification from London when they have your case and are ready for you to proceed. It will also have your case number. In the meantime, read this list for things to be working on http://www.visajourney.com/forums/topic/462904-hello/?p=6615728

Thank you, i already have most documents and photographs ready. How soon can i send off for my police certificate? Do i have to wait til the US Embassy gets in touch with me?

I have a couple more questions regarding documents required for the interview, if that's ok.

Birth Certificate -

Obtain the original, or certified copy, of the birth record of each family member (yourself, your spouse, and all unmarried children under the age of 21, even if they are not immigrating with you. If the children are deceased, so state giving year of death). Note: We will not accept the short form version of a UK birth certificate. The certificate must list both parents' names

Question - It says they want my spouse's birth certificate. Is this for couples who are already married and applying? Surely they don't want my Fiance's birth certificate as USCIS have already received it and, hopefully, sent it on (and i will add, they wouldn't accept a photocopy of the original certificate, he had to obtain a certified copy to send, hence our RFE)

Marriage Certificate -

Marriage Certificates: Married applicants must obtain an original marriage certificate, or a certified copy, bearing the appropriate seal or stamp of the issuing authority. A certificate is required for all marriages, including those that were dissolved.

Question - It states that they need the marriage certificate even those that have been dissolved. I am divorced and have sent my divorce decree already to USCIS, but, do they also want a copy of my original marriage certificate? (I have actually sent off for a certified copy of this as i don't have the original due to our my insurance company losing it)

We're still waiting to hear that NVC have received our paperwork btw. It was supposedly sent 2 weeks ago by USCIS (still confused by them stating they have sent everything to the Consulate)

Your other questions from personal experience--

The website and previous paper packet have pretty much said that same thing. My husband has kids not immigrating and a previous marriage. He did not have to provide his kids' birth certificates, his previous marriage certificate, or my (the US fiancé) birth certificate. Other people have verified they didn't either whenever somebody asks. So that's about five years of history where I have never heard anybody say differently. I have no clue why it says that.

Have you called NVC directly and asked if your file was received? I know by the time NVC got around to notifying me that the file had been sent to Lomdon, it had been in London a while. Ask NVC when the file arrived and when it left for London. If they say they never got it, then try to chase it down with USCIS. I can't ring NVC as I am in England and only have a mobile phone from which i cannot ring abroad, but i'll get Peter to ring them. As there;s no reference to NVC on the letter, I don't suppose you have their number, do you?

Hours: Monday through Friday from 7:00 AM to midnight (EST). Best time to call is 7:30 AM to 9:00 AM and 10:00 PM to midnight (EST)

If they have the case, get him to ask for the new case number in addition to NVC arrival and departure dates.

I'm so confused, frustrated and angry right now

I've been on the US Embassy in London's website to read up more on our application

As i've stated before, our letter from USCIS states that our application has gone to the 'listed Consulate' and to contact them with any queries.

This is what it says on the US Embassy/London website -

There are THREE steps involved in applying for an immigrant visa:

Step 1: Filing an immigrant visa petition with the U.S. Citizenship and Immigration Services.

Step 2: The processing of the immigrant visa either by the National Visa Center in New Hampshire or the Immigrant Visa Unit at the Embassy in London.

Step 3: The immigrant visa interview and medical examination.

So, i'm guessing that our application has gone to the Immigrant Visa Unit at the Embassy in London

I've tried phoning them, by using the switchboard number and the England contact number. All i get is sent round and round by automated messages quoting website pages at me, and then it cuts me off

I don't know what to do next?

Do i wait til they contact me???

There is nothing helpful on their website to guide me at all

The Immigrant Visa Unit at this Embassy is processing your application for a visa. While no assurance can be given regarding the appointment date of your visa interview, you should now prepare for that appointment and take the following three steps.

Complete the Immigrant Visa application Form DS-260 for each family member applying for a visa and print the confirmation sheet as this must be presented on the day of the interview. If a question does not apply to you, please mark it with a N/A. Note: The failure to complete the form promptly will delay the processing of your application.

So...are they waiting for me to fill in a DS-260 before they contact me???

Jenni-- you are on the wrong page. This is what happens in a London case

1) USCIS approves and passes your case off to the Dept of State, which is the "parent" of NVC and the embassy. At that point USCIS is done. Your case will go to NVC first.

2) NVC assigns a new Dept of State case number. Yours will start with LND for London. Then they package up your file and any others going to London and send it off with DHL With luck it is only at NVC for 3 days. Transit takes about 4 days.

3) The DHL box arrives in London. They don't open it the first day. Yes it does go from the delivery site to the Immigrant Visa Unit. When they get around to it (could be 2 weeks) they will notify the beneficiary by mail that they have received the approved petition and invite you to apply for the visa. That letter is the further instruction promised you. They don't send you forms or write out much instruction, but getting the letter means you may begin the next part because they have your file set up. The letter tells you to get your K1 instructions and forms here. http://london.usembassy.gov/iv_15.html. Don't use a phone or tablet because it automatically gives you the mobile version. It's not very good. I know the website extremely well and I can't navigate it or find things on my iPad. Looks like what you copied above might be mobile version.

Nobody is bullsh1tting you. You were told you would get further instruction. YOU WILL. You have to allow time to receive that letter of instruction. It doesn't happen instantly. There's a lot of people waiting to be served. I told you how to contact NVC so you know if it has made the pit stop there yet.

The process you found above is for immigrant visas like spouse visas. You don't do a DS-260 and you don't submit anything until London says so by sending a letter. But you can start learning the K1 process by reading the London K1 instructions. You will submit two online forms and have a medical.

Yes, i know i got angry and i guess i shouldn't have, but looking at similar timelines to ours everyone is getting through in anywhere from 2-4months. You're right, getting angry is wasted energy, and I don't usually, so i apologise

They actually did not tell us we would get any instructions, just to ring the listed consulate if we have any questions

I copied and pasted whilst on my laptop, so not sure why it picked up that blue writing

I will try to be more patient, normally it's me keeping Peter patient, i just lost it for a moment
