Affidavit of Support

Hi everyone, I just need some confirmation here...

Everywhere I look on VJ (and I've been looking a lot, for a long time), it says that I need to fill out an I-134 affidavit of support for my fiance. When the I-129f was approved and he received his packet 3 from London, it included the I-864 as the support form needed. Can anyone just confirm for me that this is correct? It's all been filled out, and it feels like it's more for a K3 than a K1 form. So I'm torn between "this doesn't feel right" and "it's the form the embassy sent, so it's the form they want."

Any advice?

Hmm... on the Embassy's own site (on this page) it says:

"An applicant for a fiancé(e) visa is not required to file an affidavit of support, form I-864 at the time he or she applies for a fiancé(e) visa. However, the Immigration and Nationality Act does require the applicant to establish to the satisfaction of the consular officer at the time of the application for a visa, and also to the satisfaction of an officer of the U.S. Citizenship and Immigration at the time of application for admission to the United States, that he or she is not likely at any time to become a public charge."

And on this page they say:

"Persons in the U.S. who wish to furnish sponsorship of a fiancee or Kii visa applicant in the form of an affidavit of support should use form I-134 which is available from the U.S. Citizenship and Immigration Services"

I'd think (hope) you can safely say they've included it in error, rather than because they've suddenly decided to change the rules just for you (which would be a bit harsh!) :unsure:

2005 - We met

2006 - Filed I-129F

2007 - K-1 issued, moved to US, completed AOS (a busy year, immigration-wise)

2009 - Conditions lifted

2010 - Will be naturalising. Buh-bye, USCIS! smile.png

They included an I-864 with my packet too, howver I filled out none because I didn't think you had to untill AOS however when I got there he made me send in an I-134

K-1 visa issued: 12/15/2006

107 days from mailing AOS package to receiving green card! Received 6/27/07 dated 6/20/07

Removing conditions:

mailed 5/22/2009

Recieved at CSC 5/23/2009

Check cashed 5/27/09

NOA date 5/26/09 - still not received

I-551 stamp in passport 6/19/09

Biometrics notice date 6/16/09

Biometrics received 6/20/09

Biometrics apt date 7/9/09

Biometrics cancellation notice 6/27/09

Biometrics apt notice date 6/26 recieved 7/7

Biometrics apt 7/22/09

Touch 7/22/09

Finally able to see online info 7/22/09

Card production email 8/19/09 date ordered 8/18

Recieved approval letter in mail 8/19/09 date 8/13!

Touch 8/19

Email stating approval notice sent 8/24/09

Green card in hand!! 8/24/09

Husband joined army and moved from San Diego to Ft. Benning GA! 8/30/11

Filed N400 based on 5 years of residency 9/12/12

Recieved email notifcation recieved package 9/19/12

Biometrics 10/22/12

Early Biometrics 10/04/12

In line for interview 10/8/12 for 8 days

Interview 11/20/12 PASSED!

You need the I-134 for the interview in London
