Am I Considered Married in the Philippines?

My husband is upset that I left understandably. His family was also insisting on me staying and just doing the AOS route but I didn't want to risk being flagged for visa fraud and getting banned and separated for YEARS from my husband and kid. He hates that I made it 10x more complicated but I just can't take the risk. And I don't want to be looked at as one of those chicks that's green card hungry. Let's admit it, southeast asian women have that stereotype.

The latest delays in the CR-1 processing is disheartening though :'(

I would not have blamed you for staying and adjusting status. You had intentions of returning and doing the K-1. Wanting your child to be born with his or her parents married is understandable.

As to a wedding the Philippines being real, you're actually married when the marriage license is signed by the officiator and the witnesses. Even when that happens 15 minutes before or after any vows are said. If your real wedding ceremony is delayed so you can have it in the Philippines, its still the real wedding ceremony to you.

Hey ! I just remembered - you not have to have the CEMAR for your husband to file the I-130. He could do that, anytime.

Hey ! I just remembered - you not have to have the CEMAR for your husband to file the I-130. He could do that, anytime.

Ya they doesn't need the CEMAR now to file but they will need it later. That was why I was telling her she had some time to get it done without issue. :thumbs:

Kudos to you for doing the right thing! The waiting will come to pass and will be insignificant once you are reunited with your partner.

She committed no fraud. It is not fraud to marry on a tourist visa while in the USA. It is fraud to come with the intent to marry and stay. But its difficult to prove intent. She on the other hand, did not stay in the USA, she returned home to follow a normal process of the CR-1, even though she still would have been entitled to stay and adjust status after she was married. I'd say getting married because you got pregnant can hardly be planned on.

No problem to get married in the USA will visiting on a Tourist visa, not returning to ones home country and initiating a spousal visa would be fraud. She is just fine.

Cheers, sis! Great to hear that you have done some research. A lot of people don't know their rights & obligations when they travel to a certain country, and apparently you're not one of them. You know how it is when embassies (not only US) generalize Filipinos as a potential illegal migrant. It's a subtle "silent" scrutiny (for some, it's some sort of discrimination) other first-world countries won't relate to during visa application.

And Darnell... I honestly thought I replied to one of your messages lmao. I'm not ignorning you at all! You provided a lot of info last time. So yeah I thought about the AOS thing since EVERYONE I spoke with at that time told me to do that - my husband, in-laws, parents, family friends, friends. My worry was that I'll be waved for visa fraud and not being able to go back to the US for years OR getting the AOS processed and not being able to leave the US to visit my family.

I guess it's really an eventuality that I'll report our marriage. I actually need to consult with a family lawyer anyways because I have some questions so I'll ask him/her the same question as the topic when the time comes. I'm not rushing tho lol.
