I have a question guys:

Why is USCIS actually processign I-130 petitions for permanent residents faster than US citizens?

Also, for the K3 visa, I called USCIS yesterday and they informed me that the processing time for I-129F is 6 months (not 5 months that shows in the web site). And when I asked if they couple teh I-129F and the I-130 petitions, the representative said no. She told they they process them separetly. She could not tell me what service center my petitions went to.

Does anybody have anymore information on teh subject?

my PD for I-130 is 16-Jul-2013 and for I-129F the PD is 26-Jul-2013

Different service centers have different processing times. It would be slower overall to stop processing one type, gather up all the others someplace else, send them over to the first center, get them unboxed, etc.

K3 is dead, whoever you talked to was wrong. USCIS has it on the books, but the NVC will make it a CR-1. DIfferent agencies, fighting eachother, and not knowing what the other is doing.

The USCIS person was correct, for them- it is the next stage, NVC, that will terminate the I-129 in almost all cases.

so, according what I saw in this website, I'm looking into February of March 2014 for NOA2 for I-130. I should then forget about the I-129F even if it was giving me hope!!!! Thanks for teh info

Who knows maybe with this logjam of a mess they have they will start processing K3's like they were intending. But for them to start processing K3's and letting them through would mean defeat for them and they would have to admit they have fallen way off the mark for I-130. I don't think they are ready to admit that. (Just saying)

Thanks dwheels76 for the reply. At least now my hopes are not that high so I will not be crushed when I find out that the K3 is not going anywhere.

But who knows, may be ..........

0.33% is still a percentage higher than absolute 0 so if that .33 makes ya feel better then it doesn't hurt anything! :)

  • 2 weeks later...

I'll try to make this short. Filed I-130 in June...got anxious when I saw the logjam starting...filed for K3 in august hoping all the VJ folks were wrong. No NOA2 for either one to date. Contacted my congressman...they sent in an inquiry to the USCIS. They got a response back within a week saying due to processing delays unrelated to my case both of my documents are together at the NBC and will be adjudicated together......in May (which of course is exactly 11 mths)....not that they might have just picked that timeline because thats what their website says is the timeline now. That could of course change to 16mths if rhis process stretches out more. Oh wait...they also apologized for the

inconvenience.

Had my congressman re-inquire specifically about the 129f/k3....heard back just this morning with resp from USCIS saying (again) that the 129f will be processed with the 130 at the NBC and that we didnt qualify for an "expedite" (didnt ask for one!)....further went on to say that due to the number of expedites going through, they are carefully screening all of those to ensure they are all legitimate.

VJ folks and what youre reading is correct....USCIS cust serv folks are not telling people the correct information.

Thank you for the updates. It hurts to know that we have to wait for so long! I'm at the four months mark right now. 3 or 4 more months to go!
