I am a US citizen recently divorced. I want to apply for a K-1 for my fiance. She tells me she will get denied because my previous marriage was in the philippines. Can anyone tell me of a similar case where this has or has not happened? And possibly what other options may we have short of getting an annulment.

I have asked a lawyer and they assured me that it would not affect the K-1 but I would like to cover all bases.

I have asked a lawyer and they assured me that it would not affect the K-1 but I would like to cover all bases.

If you were the one (US citizen) that filed for the divorce, it would be recognized in the Philippines. However, if the non-citizen (filipina) was the one that filed the divorce, it will not be recognized and you would need to be annulled in the Philippines.

Divorced happened two years after she got her citizenship which she also waited 7 years after she got here to get it.

That is no flag. You were married and things didn't work out after 7 years. Stuff happens.

What may be of concern is the short time gap from divorce and filing a new petition, which is 4 months.

Sounds like while you were still married you met your current fiance ?

Though the finality of a divorce can take a year or more, it may be a good explanation to the CO if you focus on

the date of divorce 'filing' and if you were separated for a while before filing. In other words when was the marriage over and when did you

go your separate ways before the actual divorce. They don't like to see jumping into another petition while the divorce has barely

cooled off.

Other than that I see no issues.

i know I dont fall under the IMBRA because its been more then two years its been 10 years.

Its really what my Fiance has told me she has heard in the Philippines from friends and from the radio.

I stand by my previous advice, no issues. Submit evidence to the above and make sure your fiance will be able to answer all

questions pertaining to your ex wife and your circumstances.

As to the divorce, you filed and it will be recognized. You are legally free to marry. No worries.

Beneficiaries hear all kinds of crazy rumors in their home countries.

You were married to a Filipina before and divorced her... no issue. Doesn't matter if you were married in the Philippines or not, you were divorced in the USA and divorce is recognized here ;) . You will provide a copy of the divorce decree to USCIS and would be a good idea to send a copy to your fiancee as she will need it later there in the Phils.

No need for an annulment.
