Outside Normal Processing Times & After Interview Worries

I'm usually not one to openly tell stories but I feel I should put it out there. NYC.

we got our interview today.....

here's what's going on now.

me, my wife and our son (7 months) - arrived there and we get to the interview.

She hands in her green card to the front window so they now have it. we didn't get the card back after interview.

We were taken to a room to be sworn in.

I took a questionaire (basic questions).. while the lady asked my wife questions same room.

I'm not personally good with questionaires and honestly I fell short in that department.

My memory isn't perfect especially when it comes to remembering date and time.

I got my wife's AGE wrong but I did put her DOB right.

I misread the question about if my wife was hospitalized.. the question had written "Last Year" when I misinterpreted as "This year" I implicitedly wrote " Yes - Childbirth" so our worries is I messed up by answering the questions wrong..

I noted to her that we've waited a long time for this interview to come and we've sent in so much evidence which she said was apparent since our case folder on the table was about 3-4 inches thick..

The lady said that we'd get a letter with the results in the mail.

My wife swears that the lady wrote either fax-1 or fail on the paper.. I didn't see her writing anything except marking off the questions.

I'm a logical type of thinker so it's not likely that she'd write "FAIL" if we're in the room right?

so we're both a bit disheartened at this point - still trying to keep the faith because what else can we do?

I don't know how many people here have a similar case as we have (3rd year in wait - RFE'd once. sent in evidence 2 times +1 other time).. but if anyone has any advice on what to expect.. that'd be helpful.

I'm thinking if this interview didn't pass, that they'll do another one?

At this point I don't know.. we can only pray that our case can finally complete so we can continue building our family without this always looming overhead with an unknown end date.

I'm not fully fluent with all the specific form terms but she entered with a CR1 - that's what it says on the visa.

Pending AOS CRI89 / I-751

notice said it was interview for removal of the conditional basis of your permanent resident status.

First of all, sorry to hear that this is the 3rd year you are waiting for the ROC to go through. I can't imagine the stress you are going through.

Based on what your wife thinks she saw was written, my guess is it could possibly be a code they use within the organization and depending on the person writing it it may look like "FAIL". Just a guess though.

Also depending on officers they don't tell you after the interview what status you are in. When me and my husband went to my AOS interview the officer didn't say anything after the interview and only told us to wait for the results - quite nerve-wracking really. Our paralegal who helped us with the process didn't even know. But about a week or so after the interview I got approved. So I guess like you said, you can only wait and see.

In general, if the relationship is legit there really isn't anything to worry about but just continue to wait and push through. If something is denied one can always appeal.

Have you considered filing for citizenship?

12/24/13 - Notification rec'd via email regarding card mailed on 12/23/13 (online case updated as well)

12/26/13 - 10-yr card rec'd!

One thing I have learned on this journey:

There is no such thing as an "overkill" evidence package. Submit anything and everything you can. Who knows what will prevent you from getting an RFE.

Thanks. smile.png Yeah.. it's very nerve wracking especially since we've had the same type of bad luck with Vermont Service Center..

Our K1 was pretty much blackholed for almost 3 years too before we got married and refiled..

We got mixed answers from both sides of the table.

Vermont sends an email to our representative that says that we can but not directly saying we can (wordplay).. when we go to the Field office in New York on an InfoPass, the supervisor there told us that we can't do it since this is still pending.. when I showed the field officer the letter email copy from our representative from an email from someone inside the VSC, she stated that it's not on official USCIS stationary so she can't tell us that we can file it since she'd obviously want to avoid liability if we filed and it'd go the same way.

Of course once this all clears we'll be filing the N-400 so hopefully luck will be on our side then.

Ah well.. in case anyone is reading.

With the help of our house of representative contact to check on the case, we were able to follow up on what was going on..

Got the good news.. could be considered a Christmas gift. :)

Finally got green card in hand after such a long and lengthy trial by fire; we're glad this chapter of our story is completed..

Hopefully the N-400 chapter will be better.. 2014 seems like a great year to finally start living life in pursuit of happiness.

Lovebana hello, I am happy that your case is finally approved. I believe our case is very similar to yours. We also had our interview back on Dec 2nd and since then could not get any mail for the status of our case. We also had the interview in NYC office and our officer said we will be notified by mail. However, no case update since then.

My wife called the 1-800 number spoke to the TIER 2 level supervisor and was advised that he will send an email to NYC office asking what is going on. I would like to ask how to contact the represantative. Could you please maybe share the details via private message so we can also involve maybe someone important to get this case solved ? Also, if you can tell your personal experience in order how to follow your case, it can be helpful to myself and others who are in the same boat. Thanks in advance and again glad that you finished our GC journey.

lovebane - great news !!! If I were in yer exact situation, I'd be making a new friend with the ILS human at the Congressman's office, daily/weekly banter, gifts, home cooked meals, until that ILS human punched the right button on the right human at the local office and got stuff going again.

Finally, some movement for yer wife - that's a plus !!! One less thing !
