As I was reading another post, a vj'r mentioned that they received severence pay.

I was wondering how serverence pay works ... is it optional or mandatory?

11/19/07- EAD approved online and received same day (actual approval 11/07/07) :)

12/27/07 - AOS transferred to CSC

02/26/08 - 485's approved without interview

01/14/09 - Sent I-751 - removal of conditions

02/23/10 - Biometrics

03/17/10 - Removal of conditions approved .. card production ordered

If you have an employment contract that spells out severance pay up front, you're lucky. Many people these days have an "at will" agreement where a company can let you go without giving a reason or severance. They expect you to collect unemployment. And you can expect them to keep quiet about anything that might harm your chances of getting another job.

On the other hand, when big companies have massive lay-offs, they often give "packages" to protect their public reputation as well as reward the outgoing workers.

I will get severance pay when I quit - I've worked over 10 years, so they will give me 1/2 week's pay for each year. So I will get 5 weeks pay. I know I am lucky.

2006 - Filed I-129F

2007 - K-1 issued, moved to US, completed AOS (a busy year, immigration-wise)

2009 - Conditions lifted

2010 - Will be naturalising. Buh-bye, USCIS! smile.png

Ah, sorry I wasn't more clear either - I meant to address that to hockeygal, but quoted your post too. :blush: I've never heard of anyone getting severance pay just for quitting their job (I know this is Canada we're talking about and I'm in the UK, but still) - so was very curious! I get the same package as you - a month's pay for every year worked if I get made redundant, nothing if I resign of my own volition... and that's not a bad package compared to most people I know.

Ah, sorry I wasn't more clear either - I meant to address that to hockeygal, but quoted your post too. :blush: I've never heard of anyone getting severance pay just for quitting their job (I know this is Canada we're talking about and I'm in the UK, but still) - so was very curious! I get the same package as you - a month's pay for every year worked if I get made redundant, nothing if I resign of my own volition... and that's not a bad package compared to most people I know.

Well my boss called it serverence pay but it was basically a thank you for all of the work I did for him over the past 16 years ... There was no contract and he didn't have to do what he did ... And I am pretty sure that you wouldn't typically receive serverence pay if you quit/resign from your job ...

in Canada, if you are laid off or terminated from your job by law the company is required to either give you 2 weeks notice, or pay without notice. (for salaried employees, I think its different for hourly) Labour laws in Canada vastly differ from labour laws in the US! If a company terminates you without notice they are required to give you severance pay of at least equivalent of one week's pay per year of service. A lot of companies give 2 weeks or more per year. However, if they give you 2 weeks or more notice, they are not required to give you severance pay because during that "notice time" you can be looking for other work.

If you quit your job, by law they are not required to give you anything. If they do, it is company policy, as opposed to labour law. And if they do get severance when you quit, you're incredibly lucky :yes:

I worked for the Federal Government and when I resigned I was entitled to severence pay. I don't remember the details but it did involve one weeks salary for every year you had worked if you had worked for over 6 years, which I had. If you had worked for less than 6 years then you didn't get anything. It was written into the employment contract. I had also racked up a fair bit of overtime hours so I took those as paid time off which then put my last day of official employment over the half-year mark so I was also qualified to receive the full year's paid holidays. It was nice to get the extra money as it helped to pay the final payment bills for my living expenses (utilities, phone, cable etc.) in Canada.
