Is my partner safe to visit me after applying for I-129F?

Hello all,

I am a new user of the site and have found a lot of useful and great information on here as well as some really friendly users which is always welcoming good.gif

To cut our story short, i met my girlfriend online back in march this year, she lives in Maine US and i am here in the UK. I went to visit her in august for the first time and we hit it off straight away and we both had the best 2 weeks together, her family were so welcoming and really accepted me into their circle and weve been speaking on skype every day since the very start as well as sending many letters, parcels and seperate video messages, we are both happier than we have ever been. i have another 2 week trip booked for boxing day to go and visit her again and then she is coming here to meet my family in April for the easter holiday and we truly believe we are soulmates after connecting on so many levels (minimal cheese intended :P) we both understand it is a long process from the start until we can be together but we have discussed our options indepth and we are both commited and working hard at the moment to begin our K1 Visa for me to marry and live with her in the states.

If we are to do this then i would plan to propose to her over the christmas break coming up and then she would file the I-129F once i have returned back home in january. What i would like to know is, would the application affect her coming to visit me 4 months later? im worried she would be turned away by the border control here in the UK even though the application is for me to stay in the US.

Also i understand that there is a slight grey area when it comes to me visiting the US after a file is submitted, if i were to travel back with her after her visit here in easter(which would be a surprise until the last minute) is it likely to incur problems with my application in the early stages of the whole process?

Timeline

I first filed in March-April and went to the States in August, even after NOA2 was approved. There is no problem. In the DS-156 form they ask for all the times i entered the country, you just list them there and you're good.

My fiance (the benefactor) currently resides in Argentina, so i don't think leaving the States is a problem either. Specially if it's just to visit.

Plus you have to submit proof of relationship twice, so it's very good that you guys are traveling so much to see each other =)

Each case is different and is up to the immigration officer upon entry into either country.

BUT, you should be fine. Just make sure when each of you goes to the other country that you bring evidence of strong ties back home (lease, car payments, employer letter). You may be asked for these. I'd also bring the NOA1 or NOA2 to prove that you're going through the proper legal channels and aren't looking to illegally immigrate.

I went to the UK once and my fiance came to the States 3 times after we submitted our I-129f. Neither of us ever had any trouble and were actually never asked for any proof of ties or further evidence than proof of a return flight ticket.

There is no law against visiting with a petition in the works. If you look like a terrorist, have no job, no money, and try to go for 90 days often, then the officer deciding might opt to send you home. It is totally subjective. But if you are an average looking tourist type going for a holiday then there should be no problems.
