Timeline

Im confused.

Does everyone have to file an I-134?

What about an I-864?

Or do you have to file one or the other depending on what they ask for?

The I-134 is used for K visas even though it is not a requirement. Embassies use it to assist in ascertaining if an applicant will become a public charge. There have been reported cases of a few embassies requesting the I-864 which is not meant to be a requirement until one is adjusting status in the US. What one must remember is that whilst a K visa is a non-immigrant visa, it is processed in many ways as an immigrant visa. Some embassies use the 100% of the poverty guidelines with the I-134.....some use 125% of the poverty guidelines with the I-134. The I-864 is always 125%. Best to know which/what will be required for the particular embassy you will be going through.

I just checked on the Canadian Embassy.....you will be required to use the I-134

Im not real sure right now from memory whether K-1's go through Montreal or Vancouver but here is the links.

K-1's go through Vancouver or Montréal, depending on which end of the country the beneficiary lives in. My Joel will be going through Montréal since he lives in Nova Scotia. Yeah, that I-134 and I-864 are confusing to some. I wish they'd use just one form. :)

Timeline

Always check the US Consulate's website. I checked the US Embassy website in Ukraine, and they do not require either form. They only require copies of financial documents, which may be scanned and submitted by email. They state that the submission of an I-134 is optional.

02-21-2006 Mailed K-1 application to Nebraska.

02-23-2006 USPS online confirmation of delivery.

02-24-2006 NOA1 (received 03-02-2006).

02-28-2006 Touched - first time.

03-01-2006 Check cashed.

05-03-2006 NOA2 - 68 days from NOA1.

05-16-2006 NVC received application.

06-27-2006 NOA2 again?

08-08-2006 Interview at Kiev embassy.

08-09-2006 Received the K-1 visa.

10-07-2006 Arrived at JFK airport.

10-26-2006 Applied for Social Security card.

12-29-2006 Married!!!

01-03-2007 Received Social Security card.

01-22-2007 Mailed I-485, I 765, and I-131 forms.

01-26-2007 NOA for I-485, I-765, and I-131.

01-27-2007 Received Illinois state ID card and driver's permit.

02-15-2007 Biometrics appointment.

02-28-2007 Received driver's license.

03-08-2007 I-485 approved.

03-15-2007 Received Permanent Resident Card.

03-15-2007 Applied for Social Security Card with married last name.

Everyone used the I-134 up until 8 years ago. Then they added the I-864 with more requirements and longer period of support.
