Timeline

We had our interview at the London embassy yesterday. As most of you may know we have been very concerned about having to do a waiver based on his convictions. They were 3 convictions fom two incidents, We prepared a waiver and were expecting to be denied, but as we atteneded the last window, the woman who interviewd us asked questions about the incidents and then stated that "because america allows one CIMT conviction and the other two were not we would not have to do a waiver" and she approved us! We are so happy and cant believe it, but it can happen to you. Just wanted everyone to know there is hope of approval with convctions and witout a waiver. But I would say it is always best to be prepared jst in case. Message me if you have any questions.

Be careful.. you're not out of the woods yet... There was a member who interviewed out of London in the same situation. The consular officer in London also did not believe a waiver was required, and issued the visa. When they went to the POE, CBP did not agree with the consulate that a waiver was not required and sent the individual back home to get the waiver. Fortunately, they flew through Dublin so they didn't have to go far. They had to apply for the waiver through London and get the visa reissued.

CBP has the final determination on whether or not a waiver of inadmissibility is required as they are the agency in control of admission to the US.

Hopefully everything will be OK.

But there was a thread on britishexpats a week or so ago where someone had been issued a K3, no waiver required, had gone to the US and had been refused adjustment in the US due to CIMT. Now back in the UK.

As far as I am aware you are not allowed one CIMT, all depends of course what the issues were.

Congrats with the approval.

I had 1 conviction of CIMT and should fill out a waiver form I-601

But at least your approval gives me hope for being approved which I am waiting for now.

I must add my congratulations to everyone else's, good luck to you both. We too were led to believe that you only had to have 1 cimt, in fact our case was the same, 1 cimt and two other offences and my hubby (we are both UKC by the way going thru our daughter) still had to file the waiver and his offences were over 28 years ago with the cimt being over 33 years ago and if I told you what is was you just would not believe it but it was the terminology that the police used

Anyway that is detracting from your good luck and I am really really pleased for you both, as Vicky says, and I am in full agreement with her I would not wish this on anyone.

It was Liam & Lisa :yes: he was approeved & then turned back from Dublin because of the CIMT.............I am really suprised that anyone would be approved with a CIMT on their record. My man had 2 drunk & disordery on his record & they wanted to see all the court transcripts(even though d & d is not a CIMT, if there are multiple convictions you may still need a waiver). To the OP-I would be VERY prepared when they leave to come here.
