Does this proof of domicile stuff apply if you're sending in stuff to the NVC and are a US resident? Do they require something extra at the NVC stage, like a voter registration card or driver's license?

No, if you live in the US you don't need it. That's why it's not mentioned in the guides. It is covered in the DCF guides.

A lot of these thinsg are not published and sometimes for good reasons by the emabssy so as to not create a scammers bible of sorts.

They are looking for proof of where you will live when you enter the US. What good is it to issue an immigrant visa and have the person hop off the plane in the US with nowhere to go? Obtain a letter from the person you will be living with, a copy of the rental agreement for the housing, copy of the mortgage papers, whatever applies to prove you have a place for you and your spouse to live when you arrive.

Great point. Thanks for clarifying this. I was having trouble wrapping my head around their motive, but this makes sense and is something I can definitely provide.

this is ridiculous! you love this man, you got married, you made a family and your government wants you to leave your husband for ... nobody knows for how long cause these procedures take a bunch of time. it's against humans rights.

there are procedures in Poland too but separating family members is prohibited.

maybe the officer you were talking to or the one that interviewed your husband had a bad day.

can you please keep me updated cause our situation is very similar.

I am submitted the following as proof of US domicile per Form I-864 Instructions:

1. Letter from my bank showing an active US bank account

2. Statements from E*Trade Securities LLC showing US stocks owned

3. Statement from Capital One showing my US mailing address

4. Statements from PayPal showing transfers made from PLN to USD (x3)

5. A copy of my US voter registration card

6. A copy of my Karta Pobytu decision showing my status as a temporary resident in Poland

7. A letter from mom confirming that my husband I will live at her home upon our arrival in the US

8. A letter from a company stating their intent to employ me upon my return to the US

...and we were still denied.

Any other ideas?

Wow, if that list didn't work on them, then you may have to go back to the USA ahead of your partner. I'm really surprised. You're 100% sure it's the domicile aspect you were denied for?

Other things you could consider:

* Actually signing up for and getting a lease on a place to live (rather than staying with family)

* Actually accepting and starting a job with a US employer

* Did you manage to keep a driving licence?

* Making plans for the move (such as shipping your household items, or obtaining a quote to do so)

* Any kids? Getting them school placements.

Really look over this domicile list again. I guess you re-establishing you need more proof you are coming.

Intent to employ is it an actual job offer with start date and contract agreement?

Registration in school for you.

You want to show you are really coming back sign up get any and all memberships whatever you can sign up for to show you are resident setting up shop.

You'll need to provide proof of US domicile with the AOS package, as well as bring it with you to the interview. Please read the I-864 instructions (pages 3 and 4) for information about it. This is NOT needed if the petitioner is living in the US. Here is a sample cover letter to include in the package (it lists MANY possible documents, some may not be applicable of course, to prove that you have, or will re-establish, domicile in the US):

OP - suggest you get into the Consulate during an ACS (American Citizen Services) appointment and ask a Vice Consul, directly, what proof they are requiring, and ask if they were evaluating 'proof of domicile' or 'proof of re-establishing USA domicile'.

I wont be attending school again, so registering for one is out. Its difficult to get an actual employment contract when I am not there and we dont know when we will be able to go. I've seen this letter and its great, but I am not able to get everything they submitted...

Basically the embassy has said that I must return to US before they will issue the visa. Is this allowed?

They are pretty much insisting that I go ahead of him. Can they do that??

I have a valid driver's license, but I lost it and I can only get a replacement in person. I am attempted to sign a lease, but they seem pretty set on me returning solo and I dont want to spend the money if the effort will just be wasted.
