ROC coming up and getting divorced

Hello All,

I am hoping to get some questions answered about my immigrant almost ex-husband's ROC:

We married in August 2011, and he has his conditional green card. November of last year, I found out that he had been cheating on me the entire marriage. This includes, prostitutes, e-mails, sex chat lines, hotel rooms and porn. We tried to work it out, but has never really tried. We filed for divorce and it will be final on November 18th. His conditional green card expires the same week. I know he plans on filing his ROC alone, I have refused to sign anything for him.

I have come to believe that he did NOT marry me for love. As he moved in with a woman and currently has a girlfriend as well. Also he never stopped his online porn, chat rooms or soliciting sex on Craig's list. I do have some proof of all of this.

My questions are:

Would USCIS consider this fraud?

Because of the divorce and lack of evidence that he has of our relationship, will the USCIS call me in for an interview for his ROC?

I really don't know what to do at this point. He is dishonest with everyone about everything. I even had to tell his mother about what he did after she begged me to get back with him. (he didn't tell her anything) She of course supports my decision to leave him.

Any advise would help.

USCIS would consider this fraud,

if

you had presented enough evidence to a FDNS officer at a local USCIS office.

You can do this, anytime, but suggest soonish/nowish, if you want to get this stuff into his A-File. The A-File will be reviewed during the ROC adjudication process.

How would I go about talking to FDNS officer?

I have a couple e-mails, hotel and sex chat line receipts and phone records with hundreds of numbers, some of which lead to an escort service. Would this be enough evidence? I also have screen shots of his solicitation of sex after separation and proof that he already has a new GF.

how to get a FDNS officer, live, face to face, in person?

set up an infopass appointment, then go in , and once there, tell the clerk at the counter you need to talk with the FDNS officer on duty.

Thank you for your response. I do worry that this will just make me look like the bitter wife, but non of this feels right. I wish I would have known who he really was. But he lies to everyone.

I will defiantly be looking at the information I have to consider if it's enough. Worst that can happen is that they really do think I am that bitter wife right?

An FDNS officer is charged with investigating instances of Fraud. If you feel you have enough evidence and the timeline on events makes sense to a FDNS officer, then

I suggest you pursue it.
