Mexico Custody and Father's Rights

My Mexican fiance and I have been together for almost two years and we are beginning the process of filing for the K1 visa. My fiance has a 4 year old daughter and will bring her with her to the U.S. upon approval of the K1 visa. The problem is that the father of my fiance's daughter is now saying he will not sign-off on allowing my fiance to take the child from Mexico to live in the U.S.. The father is barely responsible for the daughter, is typically only watched by his mother when the daughter is over at their family residence, and is refusing to sign any papers to allow his daughter to move to the U.S. We both believe that his actions are out of spite. I searched the internet and didn't find any helpful information, so this is the reason why I am now turning to this forum. Has anyone ever dealt with a simular situation or know the process for bringing a child into the U.S. from Mexico when the father refuses to sign-off? Any help would be appreciated. I don't know exactly about Mexico but this situation is found world wide. The embassy will demand either a letter signed by the father or a court order indicating sole custody of the child. I suggest your fiancé begins to look into the court order if the father rejects any idea of signing a letter. If the mother can not get one or the other the child will remain in Mexico.

Your fiancee (two e's) will need to file for legal custody of the child, convince him to sign (some people offer to pay the other parent off, or release them of child support obligations etc), or not move to the US with the child.

Same situation here; my fiancée has 2 boys and we had to talk to her ex and hope and pray to God that he will sign their passports. Long story short, he did and he is ok with the boys coming to the US with her. She's got her appointment on the 18th of this month. My best advice to you is try to tell the ex, that is in the best interest of the kid. If he really loves his child, put her first. Because you will have to have him sign her passport in order for her to come with your fiancée. Good luck to you !
